Conclusion Our study of grievance mediation in the coal industry expands existing knowledge about mediation in three important respects. First, we have shown that mediation can be as successful in resolving disputes when it is involuntary as when it is voluntary. Second, disputants with experience in both mediation and arbitration substantially prefer mediation to arbitration. Third, by combining the second conclusion with the results of other studies that show mediation is preferred over court adjudication, we suggest that mediation is generally preferred to adjudication, regardless of the particular type of adjudication—arbitration or court. The increase in the use of self-managing work teams in organizations has been accompanied by growing employee resistance and concern about what such dramatic changes mean to workers. Using an organizational justice perspective, this chapter identifies and examines employee concerns about the move to self-managing work teams in two Fortune 500 organizations. Employee fairness concerns regarding three types of justice—distributive, procedural, and interactional—are highlighted. This study examines interest groups undertaking lobbying activity focused on administrative rulemaking. The analysis utilizes a dataset composed of observations made during the 2009–2010 Wisconsin Legislative Session, including the entire population of groups lobbying during this time period. This research examines the participants, efforts, and coalitions utilized when groups engaged in lobbying activity related to rulemaking. Although scholars have examined interest group activity focused on rulemaking at the federal level, little work has focused on this behavior in the states. Abstract

In October 1986 the foreign ministers of Indonesia and Papua New Guinea (PNG) signed a Treaty of Mutual Respect, Friendship and Co-operation. Under the terms of this treaty the two countries have agreed not to threaten or use force against one another and not to cooperate with others in hostile or unlawful acts against each other or allow their territory to be used by others for such purposes. Provision is made also for consultation and negotiation in the event of any dispute. The treaty was hailed by President Suharto as “another milestone in the history of both countries,” while Papua New Guinea's prime minister, Paias Wingti, and foreign affairs secretary, Bill Dihm, said it would give direction for the future and inspire confidence in Papua New Guinea and its regional neighbors.  相似文献

The display of fireworks is a popular holiday celebration in the United States. Because injuries due to recreational fireworks-related explosions among private consumers are relatively common, the sale of fireworks is regulated by the federal government and is also limited by state and local laws. In contrast, because fireworks display companies are under tight safety regulations, explosions in the professional pyrotechnics industry are uncommon occurrences, and the literature contains rare reports of injuries and fatalities resulting from such explosions. We report the 2003 Fourth of July commercial fireworks explosion on Lovers Key in southwest Florida that resulted in five fatalities. Events occurring during the investigation of the scene of this explosion illustrate the unique considerations and hazards for medicolegal death investigators, law enforcement and other investigative agencies. Additionally, this case demonstrates unusual aspects of the postmortem examinations performed on victims of fireworks-related incidents.  相似文献

Proficiency testing is a key component of quality assurance programs within crime laboratories and can help improve laboratory practices. However, current proficiency testing procedures contain significant limitations and can be misinterpreted by examiners and court personnel (Garrett & Mitchell, 2018). To evaluate some of these limitations, we surveyed latent print examiners (n = 198) after they completed a Collaborative Testing Services, Inc. proficiency test. Additionally, we evaluated test performance and used a quality metric algorithm to evaluate the quality of test prints. Results do not suggest that respondents are dissimilar to the broader examiner population, although they may engage in different behaviors when completing tests versus casework. Findings show that proficiency testing contains prints of high quality and is perceived as both relatively easy and representative of casework. The test discriminated between inexperienced and experienced respondents, and verification procedures were largely ineffective in reducing errors. Objective quality metrics may provide a path forward to improving proficiency testing in a measurable manner.  相似文献
