This article considers some of the beneficial and detrimental influences of media coverage of celebrity criminal trials based on a survey administered during the criminal trial of O.J. Simpson. Analysis indicates those who exhibited a stronger psychological involvement with Simpson developed through repeated media exposure were more likely to believe his innocence. African American respondents also were more likely to believe in Simpson's innocence than were others. Gender had no effect on beliefs of Simpson's guilt or innocence. Those with a strong belief in the fairness of the United States justice system more strongly supported unrestricted media coverage of the trial. Anglo Americans more than African Americans believed Simpson's lawyers used the media effectively for their advantage. Learning about the justice system by following the case resulted in increased interpersonal discussions about the legal system.  相似文献

Public administration is confronted with a dilemma: whether to follow the course of the management orthodoxy; or to follow the course of civic humanism. It is argued that the profession should follow the latter path. Democratic public administration must be informed by a civic idealism, centering on civic virtue, that insures that morality will be realized in action. Yet in recent years, public administration has become overly entranced with the orthodoxy of the management sciences. The profession's ties with the management sciences have proven to be practically advantageous, but, overall, the association has been negative. Public administration has begun to lose its soul: its sense of civic idealism. The management orthodoxy adopts a more positivist stance, because virtue will not yield to the dominant methodology and is, hence, considered to be unreliable. A civic humanist approach to public administration requires a rather exalted notion of human potential, and a conception of political service as something both necessary and unique. Thus, in a correctly ordered republic, a public administration, guided by civic humanism, would consider the promotion of virtue among all citizens as a primary responsibility.

The 19th century brought about the creation of the modern organization. The early organizationalists argued that society would no longer need to rely upon the unpredictable virtue of its leaders and citizens. Instead, through scientific administration, all societal needs could be assessed and met by organizations. That assumption, in a more sophisticated guise, has carried over to the present day. Thus, the primary responsibility of organizational leadership is to ensure organizational survival. Such leaders are not required to be individuals of virtue; they only need to be effective motivators and managers.

If this argument is accepted, then the question becomes one of how public administration can recover its soul. First, the core of the public administration curriculum must be a political philosophy centering upon civic humanism. Second, public management goals and techniques must be modified to promulgate civic virtue. Granted, these recommendations are overtly idealistic, but, then, public administration should be an idealistic profession.  相似文献

This article highlights the continued significance of pre-capitalist formations in shaping the trajectory of economic transition in peripheral regions, even in an era of neo-liberal globalisation. There is a tendency for Marxist scholars to assume the inevitable “dominance” of capitalism over older modes of production. Using a case study from Nepal's far eastern Tarai, this paper seeks to understand the reproduction of feudal social relations in a region which is both accessible and integrated into regional and global markets. The paper traces the early subordination of indigenous groups to feudalism from the eighteenth century onwards, and the political and ideological processes through which these social relations were reinforced. Through examining the historical role of feudal-colonial alliances, however, the paper notes that pre-capitalist reproduction in Nepal is a dynamic process, actively negotiated and reinforced by the external imperatives of capitalist expansion itself as well as through the entrenched political power of landed classes. Today feudal and capitalist formations co-exist and articulate, with surplus divided between landlords and non-farm employers. Understanding the complex dynamics of feudal or “semi-feudal” reproduction in an era of globalisation is crucial if one is to identify avenues for collective mobilisation against inequitable pre-capitalist and capitalist class relations.  相似文献

Vacuum metal deposition (VMD) involves the thermal evaporation of metal (silver) in a vacuum, resulting in a uniform layer being deposited on the specimen being treated. This paper examines the use of silver on dark fabrics, thus offering a simpler operation and more obvious colouration to that of the traditional use of gold and zinc metals which must be evaporated separately. The aim of this study was to investigate the effect of fabric type, donor, mark age and method of fingermark deposition on the quality of marks visualised using silver VMD. This was achieved by collecting fingermark deposits from fifteen donors, of both sexes and various ages, by a grab or a press method. Four different fabrics: satin, polyester, polycotton and cotton were studied over a 10 day timeline of 1, 2, 3, 4, 5, 6, 7, 14, 21 and 28 + days. It was found that satin and polyester gave the most positive results, with polyester often producing excellent ridge detail. Cotton and polycotton were less successful with no ridge detail being observed. The donors also had an observable effect on the results obtained probably due to variations in secretions produced or pressures applied during specimen collection. The age of the mark or the method of mark deposition had little influence on the results obtained. Silver VMD is a viable process for visualising marks on certain dark fabrics and has the advantage over gold/zinc VMD in that the marks visualised are light in colour which contrasts well against the dark background.  相似文献

We analyze a little-studied regulatory approach that we call management-based regulation. Management-based regulation directs regulated organizations to engage in a planning process that aims toward the achievement of public goals, offering firms flexibility in how they achieve public goals. In this article, we develop a framework for assessing conditions for using management-based regulation as opposed to the more traditional technology-based or performance-based regulation. Drawing on case studies of management-based regulation in the areas of food safety, industrial safety, and environmental protection, we show how management-based regulation can be an effective strategy when regulated entities are heterogeneous and regulatory outputs are relatively difficult to monitor. In addition to analyzing conditions for the use of management-based regulation, we assess the range of choices regulators confront in designing management-based regulations. We conclude that management-based regulation requires a far more complex intertwining of the public and private sectors than is typical of other forms of regulation, owing to regulators' need to intervene at multiple stages of the production process as well as to the degree of ambiguity over what constitutes "good management."  相似文献

Parents deriving utility from children and their material standard of living will equate neither marginal utilities of consumption nor of income across states of the world and, contrary to claims in the literature but according with the historical record, will sometimes purchase fair insurance against child mortality risks even if a child's death reduces the marginal utility of consumption. Thus criticism of tort as an implicit insurance system should be refocused. It is not inefficient per se because it leads to payouts in death-contingent states but, rather, because the implicit third-party insurance which it provides crowds out more cost-effective first party insurance which households would and did purchase prior to the expansion of suppliers' liability under tort.  相似文献

The Personality Assessment Inventory (PAI) is a recent development in psychological assessment which has attracted attention because of the breadth of its coverage and the fact that it includes a four-point scale of item agreement. Matrix, Incorporated, is a psychological assessment center that specializes in the assessment of law enforcement personnel. Matrix has collected performance variables on 800 police officers who had taken the PAI prior to being hired. Correlational analysis was performed and there was a significant effect in the data. Discussion focuses upon the criteria in relation to the PAI variables, particularly with regard to aggression, antisocial characteristics and the validity scales. The data clearly demonstrate that the PAI has good potential for the selection of law enforcement officers. This paper examines the influence of the state police law enforcement academy on the performance of commissioned officers in the field training officer (FTO) program in a state in the Southeastern region of the United States. The police training academy is paramount in preparing cadets for the roles, responsibilities, and activities that graduates assume independently in the field. As such, it is important to understand the value added to future performance in the field through adequate preparation in the training academy. This study analyzes a sample of officers in the Southeastern region of the United States and explores the relationship between their performance as cadets in the academy and their performance as commissioned officers in the field training officer program. Through stepwise regression, the researcher concluded that the law enforcement training academy accounts for 10% of the performance variance of newly commissioned officers in the field officer training program. The researcher recommended further analysis of the law enforcement curriculum and of the field training officer program. This research should focus on the specific goals and objectives of the FTO program to ensure that the curriculum taught in the academy is properly aligned with the performance measures of the FTO program.  相似文献
