Ethics for Lawyers or Ethics for Citizens? New Directions for Legal Education

The Lord Chancellor's Advisory Committee on Legal Education andConduct (ACLEC) has called for the reconstruction of the ethicalfoundations of legal education. However, it has not justified its premisethat teaching legal values at the initial stage will enhance professionallegal ethics. It is argued that the present system of education, given itstechnocratic, individualistic, and authoritarian tendencies, cannot meetACLEC's challenge. A more ethical legal education can be envisagedwithin a neo-Aristotelian framework. This perspective emphasizes thereflexivity between micro and macro ethics, and utilizes the active andparticipatory learning approaches which should enable students to engagein meaningful moral discourse and problem solving.     

Natural Settings Trials — Improving the Introduction of Clinical Genetic Tests

Approaches to genetic testing differ in the research setting and the clinical setting. More data are needed to develop approaches that will best facilitate the use of new genetic tests in the clinical setting, especially settings where genetic testing has not been widely used, such as in primary care. Furthermore, data are needed to establish the clinical utility of new genetic tests in the general practice setting. Natural setting trials are proposed as a strategy to develop this information. While natural setting trials are clinical research studies and will expose participants to some degree of risk, the risks are different, and arguably less than the risks those same individuals would otherwise face if the test went directly into clinical practice. Ultimately, clinical practice and safety of new genetic tests can be improved by adding the evaluation provided by natural setting trials.     

Misclassification probability of dental discrimination functions for sex determination

Misclassification probability of dental discriminant functions for sexing American whites was evaluated using three verification procedures. These validation techniques involved sample resubstitution, jackknife classification, and use of a holdout sample. Resulting discriminant score distributions yielded correct classifications ranging between 65 and 81% depending upon the particular tooth combinations selected. Dental discriminant functions are applicable to forensic science cases if used with caution.     

Family Influences on Female Offenders’ Substance Use: The Role of Adverse Childhood Events among Incarcerated Women

Childhood maltreatment, witnessing violence, and growing up with absent, addicted, or mentally ill caregivers influence adult physical and psychological well-being and may play an important role in female offending. This study utilizes data from a study of 60 incarcerated women to examine a possible intervening variable in the victimization-crime relationship. We conduct qualitative analyses to examine family influences on substance use among female offenders. Findings indicate that substance use may arise from a need to cope with child victimization and adversity, and that factors such as poor parental supervision may contribute to girls’ substance use. After onset of drug use, many women may turn to further criminal activity to support their habits. Implications for research and intervention are addressed.     

Liberal equality: political not erinaceous

Ronald Dworkin’s Justice for Hedgehogs defends liberal political morality on the basis of a rich account of dignity as constitutive of living well. This article raises the Rawlsian concern that making political morality dependent on ethics threatens citizens’ political autonomy. Thereafter, it addresses whether the abandonment of (erinaceous) ethical foundations signals the demise of Dworkin’s liberalism and explores the possibility of laundering his conception so as to facilitate a marriage between the political philosophies of Rawls and Dworkin. The article finishes by rebutting some objections Dworkin raises against Rawls’s account of public reason.
