城镇化进程中农村土地制度改革的经济学分析

在我国城镇化持续发展阶段,农用土地不断被征用引发一系列的经济社会问题,客观上产生了国家经济建设与居民安居乐业之间的博弈,要从制度上分析如何通过市场配置有限的土地资源,严格规范土地管理,积极开展土地承包经营权流转,加快农业现代化,促进经济社会的和谐发展与安全稳定.     

构建以社会保障基本制度为核心的社会保障社会系统工程

社会保障与人民的幸福安康息息相关,党和政府越来越重视我国社会保障事业的发展,明确提出了广覆盖、保基本、多层次、可持续的发展思路。在我国社会保障建设利好的态势下,面对我国社会生产力水平发展不高、社会物质财富尚未极大丰富,社会保障需求大于社会保障供给的国情,积极构建以社会基本保障制度为核心的社会保障社会系统工程,在加快、加大社会保障基本制度建设速度和力度的同时,形成社会保障的社会辅助机制、市场机制、准市场机制、家庭补充机制,构建和培育拓展社会福利的发酵机制,扩大社会保障的辐射和渗透效益具有重大的社会现实意义。     

The Heritability of Palatal Rugae Morphology Among Siblings*†

Although there is clinical applicability of the palatal rugae as an identification tool in forensic odontology, controversy exists whether the palatal rugae patterns are stable or variable. The greater the genetic component, the higher the probability that palatal rugae patterns are stable. The aim of this study was to compare the palatal rugae morphology between full siblings and the proportion of variability due to genetic component. This cross-sectional study was conducted on digital models of 162 siblings aged 15–30 years old. The palatal rugae patterns were assessed with Thomas and Kotze (1983) classification using Geomagic Studio software (3D Systems, Rock Hill, SC). The palatal rugae morphology between siblings showed significantly similar characteristics for total number of left rugae (p = 0.001), left primary rugae (p = 0.017), secondary rugae for right (p = 0.024) and left sides (p = 0.001), right straight rugae (p = 0.010), and right convergent rugae (p = 0.005) accounting for at least 6.25%-12.8% of the variability due to heredity. Despite the similarities found, the palatal rugae patterns showed significant differences between siblings of at least 46.9% (p = 0.001). Zero heritability was found in 9 of the 14 rugae patterns. Meanwhile, total number of rugae, primary, backward, and convergent rugae showed moderate heritability (h² > 0.3) and total number of secondary rugae showed high heritability (h² > 0.6). In conclusion, despite the individuality characteristics, an appreciable hereditary component is observed with significant similarities found between sibling pairs and the palatal rugae patterns were both environmentally and genetically influenced.     

DIP-STR在不平衡混合DNA样本中的分析研究

当前,DNA检验技术作为打击犯罪的利器,在法医鉴定中发挥着巨大作用。但对于性侵、暴力犯罪等案件中提取的混合DNA样本,尤其是从受害人或嫌疑人的接触物上采集的高度不平衡混合DNA样本,利用常染色体STR检验方法得到的结果通常不是很理想。由于PCR扩增偏倚,从混合样本中检测出痕量DNA分型是一个巨大的挑战,也是当前法医DNA检验的一个难点。近年来的研究显示,利用新型连锁遗传标记DIP-STR,即结合缺失或插入多态性片段DIP(deletion–insertion polymorphisms)和STR的连锁位点,可以用来检测出混合DNA样本中任一性别和细胞起源的微量DNA,甚至在DNA混合比例高达1:1000时,DIP-STR标记的灵敏度、特异性仍旧相对较为理想。因此,DIP-STR标记的分析可以作为常染色体STR检验的有效补充。本文将对DIP-STR在不平衡混合DNA样本分析中的研究背景、方法及其应用前景进行综述。     

Asian Contributions on Democratic Dignity and Responsibility: Rizal,Sukarno and Lee on Guided Democracy

Democracy as political doctrine has its fair share of controversies over the adjudication of rights and the prioritization of the individual over the community. These debates have largely derived from its western genesis. The current stage of global development has however supplied many non-western perspectives on democracy which suggest that any consensus over an identifiable body of democratic thought is likely to witness more sub-diversity than ever before. This article argues that contemporary Asian thinkers on the philosophy of government have a valuable contribution to make to democratic discourse notwithstanding the clichés of the Asian Values debate of the 1990s. By performing a sampled reading of José Rizal, Sukarno and Lee Kuan Yew on their diverse interpretations of guided democracy in a nationalistic context, it will be shown that these three modern Southeast Asian political thinkers would offer some tentative Asian insights on the democracy of dignity and of responsibility.

论商标法的价值定位——兼论我国《商标法》第1条的修改

商标法的价值定位决定了商标法的取向,影响着商标具体制度的设计.目前我国《商标法》将"加强商标管理"、"保护商标专用权"和"维护消费者利益"作为立法宗旨,具有浓厚的计划经济色彩.为适应市场经济的需要,我国应将商标法定位为"维护消费者利益"、"保护商标权人利益"和"维护市场公平竞争",并应以此修改我国《商标法》的第1条规定.     

Validation of the Investigator 24plex QS Kit: a 6-dye multiplex PCR assay for forensic application in the Chinese Han population

The Investigator 24plex QS Kit (QIAGEN, Hilden, Germany) is a 6-dye fluorescent chemistry short tandem repeat (STR) polymerase chain reaction (PCR) amplification system that simultaneously amplifies 20 of the expanded Combined DNA Index System (CODIS) core STR loci, SE33, DYS391, and the standard sex-determining locus, amelogenin, as well as two special internal performance quality sensor controls (QS1 and QS2), which are included in the primer mix to check the PCR performance. This study was designed to be a pilot evaluation of this STR-PCR kit in a Chinese Han population regarding the PCR conditions, sensitivity, precision, accuracy, repeatability, reproducibility, and concordance; tolerance to PCR inhibitors; applicability to real “forensic-type” samples; species specificity; mixture, balance and stutter analyses, and utility in a population investigation. The exhaustive validation studies demonstrated that the Investigator 24plex QS system is accurate, sensitive and robust for STR genotyping. In addition, these genetic markers in the population data in our study indicated that they can also be useful for forensic identification and paternity testing in the Chinese Han population.

论检察权的合理配置

检察权是法律赋予检察机关各种职权的总称。我国检察权的配置总的来看比较科学,但仍然存在一些不尽合理的地方,突出表现为六个方面的问题,究其原因就在于对检察权的定位不够准确,影响和制约了检察职能的发挥。在我国权力结构中,应坚持检察机关为法律监督机关、检察权为法律监督权的宪法定位,并由此提出检察权的合理配置分为两个层面:宏观层面和微观层面,建议司法体制改革中,应当首先从宏观层面对检察权进行合理配置,增设暂缓起诉制度,完善撤回起诉制度,强化民事行政监督权,赋予民事行政公诉权。     

政治社会化的维度

政治社会化是政治民主进程中的必要过程,但它不是解决政治领域内一切问题的灵丹妙药。在强调政治社会化积极作用的同时,要从历史经验、社会分工、政治冷漠、自由生活等四个视角认识政治社会化的维度,注意政治社会化的强度、范围和标准。
