民法基本理念现代化问题的理论反思

私权神圣和私法自治构成了近现代西方民法基本理念的核心内容.随着古典自由主义思想的日渐衰微和新自由主义思潮的兴起,西方民法基本理念呈现出由"私权本位"向"社会本位"或"社会优位"观念的转变.反观当代中国,集体主义仍为社会意识的主流,私法的历史传统相当薄弱,以个人权利保护为核心理念的民事法律制度仍然缺失.我国民法基本理念的现代化应该朝着树立私权以及私法观念的方向前进.

The Mistreatment of Others: Discrimination Can Undermine University Identification,Student Health,and Engagement

Past research documents the extent that discrimination experiences and observations can undermine people’s health and performance. In addition to discrimination’s direct consequence for targets, discrimination implicates the morality of the larger community where it occurs. Perceptions of community morality could predict community identification that, in turn, could predict health and performance. To test this serial mediation hypothesis, 615 second- and third-year university undergraduates reported the frequency of discrimination observations and experiences. Students’ perceptions of the university community’s morality mediated the relationship between discrimination and the extent that they identified with the university. In turn, university identification mediated the relationship between university morality and students’ academic engagement and mental health. However, only university morality reliably mediated the relationship between discrimination and physical health. Discrimination can affect the health and engagement of all community members, even observers who are not part of the targeted group.     

Does Participation Lead to Ongoing Infrastructure Maintenance? Evidence from Caribbean Landslide Mitigation Projects

Donor-funded infrastructure projects may focus on construction and neglect longer-term sustainability. Engaging local communities has been proposed as way of inducing ongoing maintenance by facilitating coordination and a sense of ownership, but there is little evidence on its effectiveness in practice. We analyse data from inspections of 103 landslide hazard mitigation drains in Saint Lucia several years after construction. We conclude that community participation at the beginning of the project, by accessing local knowledge, is associated with improved construction quality, but appears to have no impact on subsequent maintenance, suggesting that contractual provision for maintenance may be required.     

Persuading the undecided: An interdisciplinary approach to increase public support for the arts

This paper uses an interdisciplinary approach to address the issue of lack of public support for the arts. The paper utilizes an acquisition- and transaction-value approach from marketing and economic theory to identify 4 segments that vary in the degree to which members of each segment value and support the arts. Using system 1 and system 2 processing styles as discussed in management literature, as well as central and peripheral routes to persuasion as studied in psychology, the segments are examined in order to understand their potential information-processing styles. Last, using advertising and communication theories, the paper proposes the use of information and transformational communication strategies to create better persuasive communications that match the processing styles of targeted segments of undecided decision makers in order to garner greater public support for the arts.
