Stakeholder citizenship: the complexities of Polish migrants’ citizenship attachments in the context of the Scottish independence referendum

This article focuses on the experiences of Scotland’s largest foreign-born minority group, namely Poles, in the run-up to the Scottish independence referendum in 2014. We draw on 20 in-depth interviews to explore our participants’ intentions and justifications for voting (or not) in the referendum. We found that our participants tended to emphasise the jus domicili principle when justifying their eligibility to vote in the referendum. However, our participants extended the jus domicili principle in their justifications to also include the intention to stay in Scotland as a central aspect of their continuing stake in (and right to vote in the referendum to determine) Scotland’s future. Through exploring our participants’ justifications for voting in the referendum, we were able to examine and better understand how migrants constitute their citizenship through articulating their substantive attachments (social, economic and relational or familial) in their adoptive country and in their country of origin.     

Reading aloud as performance and its representation on television programmes for children

ABSTRACT

The social practice of reading aloud picture books to children, or shared reading, has been represented on many televisions programmes broadcast across English-speaking countries. This article views shared reading as a performance, and explores its transformation on two television shows for children and the potential of such shows to promote reading engagement and literacy development. Taking a critical multimodal perspective, we analyse shared reading in real life and on television as a social practice, focusing on the ways the participants talk about the picture book, relate it to exterior texts or activities, and legitimise shared reading through the employment of multimodal and interactive strategies. The analysis reveals significant differences between actual adult–child shared reading and its representation on television. The comparison illustrates the potential benefits and limitations of television shows in which picture books are read to the viewer, in terms of promoting shared reading among families and supporting young children’s emergent literacy development.     

Watering Down the Court of Justice? The Dynamics between Network Implementation and Article 258 TFEU Litigation

With the establishment of an administrative network to manage implementation of the Water Framework Directive (WFD), a more consensual approach to judicial enforcement seemed like a natural next step. This anticipation was partially derived from the experimentalist nature of the WFD, requiring concerted action in the specification and application of its open‐ended and broad provisions. This article assesses how important changes in WFD implementation practices shape the role played by the Court of Justice with respect to Article 258 Treaty on the Functioning of the European Union. The examination of the WFD litigation reveals interesting tensions. Network‐based implementation practices keep Member States accountable for the progress of implementation and make a subsequent legal action swifter. At the same time, implementation practices remove from courts those issues that may be better solved by network participants. The results show how the function and exercise of judicial enforcement is influenced by the ways in which legislation is implemented.     

Some individual differences in perception of the evidence and the verdict choice

Abstract

For the last century, social research has provided evidence that contradicts the idea of objectivity in judicial procedure. As a result, research on jurors' potential bias has emerged. We propose an alternative to traditional jury, one in which social researchers collaborate with judges and lawyers, providing them with information on the juror bias. Legal authoritarianism is one of the characteristics of personality, which seems to be linked to juror verdicts. We present two studies, which develop a specific measure for this variable. The first study shows the relevance of legal authoritarianism as a variable to describe the psychological profile of juror-eligible respondents. The second study explores the relationship between legal authoritarianism and interpretation of the evidence, as well as the potential of this variable to predict verdicts.

Domestic Judicial Institutions and Human Rights Treaty Violation

Democratic and autocratic states routinely violate their international agreements protecting human rights. Scholars typically link ratification and compliance behavior theoretically but test their models separately; however, if the behaviors are jointly determined then we should treat them that way empirically. We consider how domestic judiciaries influence the joint choice to ratify and comply with international human rights regimes. Using data on the ratification status of states under the Convention Against Torture (CAT), states' torture practices, and a series of measures of judicial effectiveness, we examine whether legal institutions are likely to constrain state behavior and by implication raise the costs of ratification.

This article surveys the official narrative on representation of Estonian identity and Estonianness through the tourism strategy implemented by Estonia from 2007 to 2015. Gathering material from brochures and documents targeting foreigners produced by the Estonian Institute and “Enterprise Estonia” (EAS) and analyzing the logic behind the interior design of Tallinn Airport, we engage with current debates on identity construction in post-Soviet spaces. In particular, we suggest that along with an established body of literature looking at the role of state actors in the construction of identity, studies should consider the role of nontraditional or non-state actors in identifying and promoting identity markers.
