Anti‐suit Injunctions and the Doctrine of Comity

Hin‐Pro International Logistics Limited v CSAV is an important case in the areas of anti‐suit injunctions, contractual interpretation and private international law. Despite the ambiguities surrounding the jurisdiction clause contained in the bills of lading, the Court of Appeal construed the jurisdiction clause as ‘exclusive’ in the context of a ‘contractual background’, and affirmed the continuation of the anti‐suit injunction granted by the Commercial Court. It is argued that the approach of applying the common law principles of contractual interpretation to a bill of lading is questionable. The approach used to apply English private international law is problematic in a number of ways. There are legitimate reasons for concern that the doctrine of comity in English private international law may become undermined as a result.     

Obstacles and Opportunities for Sustaining Performance Management Systems

Measuring performance in public organizations has been a growing trend for several decades. Designing, adopting, and implementing this style of management system have been the topic of much practitioner and academic deliberation. One struggle those determined to adopt performance measurement and management systems have faced, though, is the ability to sustain them over time and actually engrain them into their decision-making frameworks. Countless barriers to long-term success exist for public organizations and this article seeks to identify and categorize them. Using a mixed-method survey design, this research shows which factors are the most important to organizations hoping to build a performance system that can stand the test of time. Capacity, knowledge, and buy-in limitations pose serious threats to these reforms and it takes a concerted effort to cultivate not only support from employees and management to pursue performance management but the technical and conceptual capacity to design the right system for the organization.     

Perception of Pay Equity in Public Universities in Ghana: Effect on Individual Performance and Work Behavior

Equity theory proposes that individuals perceiving inequity seek to restore equity through appropriate behavior. This research aimed to study the relationship between perceived pay equity and individual job performance among lecturers in public universities in Ghana. Using a survey of 313 lecturers, we found that employees’ perception of equity in the pay system is a significant factor in determining their job performance. Therefore, we recommend that managers attend to equity in the design and implementation of pay systems. Moreover, issues relating to the reward system should be carefully communicated to employees in order to prevent unnecessary perceptions of inequity.

Broadcasting Regulation and Building the Multicultural Canadian Nation: Understanding the CRTC's Al-Jazeera Arabic Decision

The Canadian Radio-Television and Telecommunications Commission provoked extensive debate in 2004 when, in a seminal decision, it approved controversial and popular satellite television network Al-Jazeera Arabic for Canadian distribution. While the broadcast regulator's decision placed what some consider onerous responsibilities on potential Al-Jazeera carriers, others argue that given past egregious incidents of abusive speech on the network, it should not have been approved at all. This article accounts for the policy and regulatory context in which the Al-Jazeera decision is situated and the factors leading to the decision. The article argues that in proscribing abusive speech on the airwaves, the regulator locates freedom of expression within the context of a mandate to ensure that the Canadian broadcasting system makes a tolerant, multiethnic and multicultural Canadian nation imaginable.     

Information Technology Transfer to African Nations: An Economic Development Mandate

The global revolution caused by the advancement and deployment of information technology (IT) demands the full involvement of the entire international community if the technology is to be ultimately effective. IT which continues to revolutionize all facets of life in the developed world has the potential to affect African countries in historic proportions. IT presents several opportunities and challenges for developing African countries, including Africa. There are opportunities for fostering technological capabilities, and thus enhancing the prospect of economic development. This paper highlights the opportunities facing African countries in the information age. The challenges that African countries must face in order to experience the full impact of the technology are discussed. A policy framework for the transfer of IT to African countries is presented and several Internet resources relating to IT transfer in Africa are provided.     

Election campaigns and the cyclical nature of emotions—How politicians engage in affective polarization

Do politicians get emotional during an election campaign? We examine the existence of changes in partisan in-group favoritism and partisan out-group hostility among political elites by evaluating the degree to which they fluctuate before, during and after election campaigns. The lack of elite level panel data has prevented scholars from studying the dynamics of politicians' emotions around the most emotionally intense political event in democracies: elections. We focus on Sweden around the 2014 election and follow more than 700 Swedish politicians before, during and after a national election campaign using a unique three-wave panel survey. The results reveal that politicians' emotions towards other parties are affected during the election, but less so for their own party. Our study adds to the body of recent evidence that campaigns mobilize partisan identities and increase partisan animus.     

Microeconomic Determinants of Income Inequality in Rural Pakistan

Inequality matters for poverty reduction. However, it is often unclear what policy could do to change the distribution of income as to date there is little quantitative evidence about the household characteristics that determine the level of income inequality and its changes over time. This paper sets out to identify these determinants by adapting a regression-based inequality decomposition technique and applying it to panel data from rural Pakistan. Land ownership is key to explaining the level of inequality, but not its changes. In contrast, higher education drives changes, but not the level of inequality. Household location affects both, reflecting growing differences in market access across regions.
