The power to permit a retrial after a conviction has been quashed on appeal is an established part of criminal procedure, with over a third of successful appeals against conviction in England and Wales now resulting in a retrial being ordered. Despite this, relatively little attention has been paid to the circumstances in which it is appropriate for such permission to be granted. This article reviews the practice of the courts, offering a rational reconstruction of the reported cases. It argues that appeal courts have improperly entered into consideration of matters which should properly be reserved to prosecutorial discretion. While retrial after a quashed conviction should only be possible with the permission of the appeal court, such permission should – where sought – always be granted unless insufficient competent evidence was led at the first trial or a second prosecution would be an abuse of process. 相似文献

Women are underrepresented at senior levels in most companies. This article examines whether gender differences in the propensity to negotiate contribute to this pattern. Based on a behavioral experiment run in a major investment bank in the United States, I found that fewer women than men are willing to negotiate, but employees who have a propensity to negotiate are promoted on average seventeen months more quickly than those who do not. Women advance more slowly than men, which accounts for the underrepresentation of women in senior positions. I conclude that gender differences in the propensity to negotiate partially explains why women are on a "slow elevator" to the top. 相似文献

Studies on the motivation for violent street crime, such as robbery and assault, have tended to draw on either the rational choice or the subcultural perspective. This study explores the extent to which violence on the street can be explained by rational factors associated with the successful commission of the offence or social factors related to street culture. The study is based on qualitative interviews with 55 violent street offenders who were serving sentences for street robbery and assault in six prisons in the United Kingdom. The findings, based on accounts of 101 incidents of street violence, identified four main explanations for street violence: (a) successful offence enactment, (b) buzz and excitement, (c) status and honor, and (d) informal justice. The article concludes that there might be benefits in combining the insights of both perspectives by generating an integrated theory that would properly explain both the rational and the seemingly irrational components of street violence. 相似文献

Given the crucial role of eyewitness evidence, statements should be obtained as soon as possible after an incident. This is not always achieved due to demands on police resources. Two studies trace the development of a
new tool, the Self-Administered Interview (SAI), designed to elicit a comprehensive initial statement. In Study 1, SAI participants
reported more correct details than participants who provided a free recall account, and performed at the same level as participants
given a Cognitive Interview. In Study 2, participants viewed a simulated crime and half recorded their statement using the
SAI. After a delay of 1 week, all participants completed a free recall test. SAI participants recalled more correct details

This article presents a continuum of possible coproduction arrangements between scholars and practitioners and suggests that greater engagement is necessary to bridge the commonly cited problems that create the gap between research and practice. Reflections on an Australian case of a major public sector coproduction partnership, the highest degree of interaction on the continuum, are used to argue that successful engagement between practitioners and scholars is possible, while also recognizing the difficulties inherent in this process. The benefits and challenges of this partnership are presented, as well as critical factors that drive effective relationships. Lessons are drawn for the development of future coproduction partnerships, including the importance of recognizing that both scholars and practitioners are, in fact, researchers. 相似文献

Over the last few months extremely positive accounts have been circulating of Cuba's role and approach in the COVID-19 response, both nationally and internationally. A universal healthcare system with family doctors and nurses providing door-to-door services, as well as the swift introduction of measures to control movement have been some of the factors underlying this relative success. This paper explores the potential for reducing homicide, with a particular focus on the United Kingdom. It draws upon data from the Homicide Index, international research on homicide, and the general crime reduction literature. Homicide is highly diverse in its characteristics, causes and dynamics, so effective strategies to reduce it are likely to require tailoring to specific forms. The paper focuses upon four important categories: domestic (partner) homicide; the killing of infants; alcohol-related homicide; and homicide involving guns and knives. Attention is also paid briefly to issues around dangerous offenders and mental disorder, and to homicide victimisation in relation to specific occupations.This paper was written in 2001 and accepted for publication by Crime Law and Social Change in 2002. Some minor updating has been undertaken by the authors, but due to the delay some sections will inevitably not refer to the most recent research. Several state and local government organizations lobbied Congressduring the formation of the Help America Vote Act (HAVA). Thisarticle distinguishes between "general" government organizations(those that represent the general interests of state and localgovernments) and "functionalist" organizations (those that implementspecific programs or functions).
