Congestion in trial courts continues to create a dilemma in judicial administration. In Florida, an effort to address this problem in the juvenile justice system emerged with legislative authorization of community arbitration programs. Implementation came in a joint endeavor of a community and a university to develop a juvenile arbitration program. Assessment of the program in reduction of caseload, cost efficiency, recidivism, reduction of delay prior to hearing, and volunteer participation suggests that community arbitration can be a viable alternative.  相似文献

This article reviews methodologically and substantively the large literature on conflict expansion. It compares and contrasts the two quite different approaches that have been used. One is based on a contagion/diffusion framework that sees war involvement coming from the outside environment. The second is a Realpolitik, rational actor approach that sees involvement in ongoing wars as a result of conscious actions to achieve foreign policy goals. The contagion/ diffusion framework is rejected as fundamentally flawed but which can provide needed modifications to a more Realpolitik perspective.  相似文献

This article provides an overview of a new feature in Public Administration Review called Evidence in Public Administration. This feature was created to provide a space in which scholars and practitioners of public administration can meet to engage in a dialogue about evidence in public decision making. In this feature, we will shine a light on the evidence needed to make effective decisions and examinations of the evidence that currently exists for contemporary public sector efforts. We explicitly want to create a resource for both practitioners and scholars to consult when trying to find evidence on a particular topic and to know the limitations and parameters of that evidence. This article lays out the purpose, scope, and rationale for the feature, as well as a call to engage in this endeavor.  相似文献

Both traditional and gestational surrogacy are now entering the public mind as a major public policy issue, because of concern for apparent truncation of the surrogate mother’s rights. This article sets out to investigate some key relevant rights, the policy issues as yet unresolved, and the character of the current regulatory regime. Modern medicine, specifically assisted reproductive technology, has made legislation obsolete in many jurisdictions around the world, including in Malaysia. These new medical practices present many significant legal problems, with which the courts and legislators still struggle. A proposed statute, the Assisted Reproductive Technique Services Act, aimed at regulating reproductive technologies, including surrogacy arrangements, will be introduced in the Malaysian parliament soon. The proposed Malaysian Act will address issues such as surrogacy, sperm or egg banking, and sperm donation. Malaysia is moving cautiously towards regulation on this issue and is trying to avoid becoming a ‘rent-a-womb country’. Thus, this article asks the question as to what policy considerations are in place, in the current Malaysian regulatory regime, to care for the rights of the surrogate mother? It will try to show that there is still a danger that Malaysia could become a ‘rent-a-womb country’, with its necessary implications of property rights over surrogate mothers. The article employs section-by-section synthesis to reach its conclusions. Argument will suggest that the current state of the law in Malaysia, as to both traditional and gestational surrogacy, seems to be that the regulatory regime is a combination of the general law, private ordering, registration and enforceable professional ethics. However, there is no Malaysian statutory law in place, in the contemporary social context, expressly prohibiting a term in a surrogacy contract that might imply property rights over the surrogate mother. This is a serious apparent lacuna in the law, and might suggest that the laws of transnational crime be considered, as an alternative, as applicable to the surrogacy agreement.  相似文献

One of the most exciting developments in Canadian federalism has been the emergence of Aboriginal self-governing regions. This paper constructs a theoretical framework for exploring the evolution of intra-jurisdictional relations in the self-governing Inuit regions of the Canadian Arctic. Intra-jurisdictional relations in these regions are characterized by a unique set of relationships between elected governments and organizations that represent the beneficiaries of land-claims agreements. Using the literature on historical institutionalism, we argue that the nature of Inuit intra-jurisdictional relations following the establishment of self-government can be explained by the institutional choices made prior to the signing of land-claims agreements and/or self-government agreements. To illustrate the potential of our framework for analysing Inuit intra-jurisdictional relations, we briefly examine the experiences of Nunavut, an Inuit-dominated region and the newest territory in the Canadian federation.  相似文献

Latin American firms are moving from narrow philanthropy to broader engagement with development priorities. We examine this shift with data from Alianzas, a development programme promoting private contributions to health and education in Guatemala. We use Solomon's (2010) dimensions of proliferation, professionalisation, and partnering to compare firms' pre-Alianzas efforts with programme activities. Both firms with established and new philanthropic programmes engaged with Alianzas (proliferation). Most participants were willing to steer efforts towards public priorities (professionalisation) and collaborate with government (partnering). Given chronic underfunding of health and education priorities in Guatemala, we suggest that private contributions to public programmes be institutionalised.

De la philanthropie à la responsabilité sociale des entreprises au Guatemala : évaluer les changements obtenus à travers les Alianzas

Les entreprises latino-américaines sont en passe de s'éloigner de la philanthropie étroite et choisissent plutôt une approche large du travail sur les priorités de développement. Nous examinons cette évolution à partir de données émanant des Alianzas, un programme de développement qui favorise les contributions privées à la santé et à l'éducation au Guatemala. Nous employons les dimensions de Solomon (2010) de prolifération, professionnalisation et établissement de partenariats pour comparer les efforts des entreprises pré-Alianzas aux activités de programme. Des entreprises dotées de programmes philanthropiques établis ainsi que nouveaux ont collaboré avec des Alianzas (prolifération). La plupart des participants étaient disposés à orienter les efforts vers les priorités publiques (professionnalisation) et à collaborer avec le gouvernement (établissement de partenariats). Étant donné le sous-financement chronique des priorités en matière de santé et d'éducation au Guatemala, nous proposons que les contributions privées aux programmes publics soient institutionnalisées.

De filantropia à responsabilidade social corporativa na Guatemala: avaliando mudanças através do programa Alianzas

Empresas latino-americanas estão mudando de filantropia limitada para engajamento mais amplo com prioridades de desenvolvimento. Examinamos esta mudança com dados do Alianzas, um programa de desenvolvimento que promove contribuições privadas para a saúde e educação na Guatemala. Utilizamos as dimensões de Solomon (2010) de proliferação, profissionalização e parceria para comparar os esforços das empresas pré-Alianzas com atividades do programa. Tanto as empresas com programas filantrópicos estabelecidos quanto as empresas com programas filantrópicos novos engajaram-se com a Alianzas (proliferação). A maioria dos participantes desejava dirigir esforços para prioridades públicas (profissionalização) e colaborar com o governo (parceria). Tendo em vista o baixo investimento crônico nas prioridades da saúde e educação na Guatemala, sugerimos que contribuições privadas para programas públicos sejam institucionalizadas.

De la filantropía a la responsabilidad social corporativa en Guatemala: cómo se evalúan los cambios a través de Alianzas

Las empresas latinoamericanas están abandonando sus prácticas exclusivamente filantrópicas para asumir un mayor compromiso con las prioridades del desarrollo. Los autores analizan esta transición a través de la información obtenida de Alianzas, un programa de desarrollo que promueve el financiamiento privado en las áreas de salud y educación en Guatemala. Utilizan las categorías de Solomon (2010) –difusión, profesionalización y construcción de acuerdos– para comparar las actividades de las empresas antes y después de participar en el programa Alianzas. En el programa Alianzas participaron tanto las empresas con experiencia en actividades filantrópicas como las que no la tenían (difusión). La mayoría de las empresas que participaron encaminó sus esfuerzos hacia las prioridades públicas (profesionalización) y hacia la colaboración con el gobierno (construcción de acuerdos). Dada la escasez crónica de financiamiento para la salud y la educación en Guatemala, los autores sugieren que se institucionalicen las donaciones privadas para los programas públicos.  相似文献

Behavioural case linkage assumes that offenders behave in a similar way across their crimes. However, group offending could impact on behavioural similarity. This study uses robbery data from two police forces to test this by comparing the behavioural similarity of pairs of lone offences (LL), pairs of group offences (GG) and pairs of offences where one crime was committed alone and the other in a group (GL). Behavioural similarity was measured using Jaccard's coefficients. Kruskal–Wallis tests were used to examine differences between the three categories within the linked samples. No statistically significant differences were found for linked GG compared to linked LL pairs. However, differences emerged between GL and the other categories for some behaviours (especially control) suggesting caution should be applied when linking group and lone offences committed by the same perpetrator. Differences between linked and unlinked pairs were assessed using receiver operating characteristic. The results suggest it is possible to distinguish between linked and unlinked pairs based on behaviour especially within the GG and LL categories. There were, however, fewer significant findings for the GL sample, suggesting there may be issues linking crimes where the offender commits one crime as part of a group and the other alone.  相似文献
