中央提出监狱劳教工作的“首要标准”，是依法治国的必然要求，为教育改造工作指明了方向。当前劳教工作贯彻“首要标准”应从创新管理模式、教育内容和手段、加强劳教人民警察队伍建设、加大财政保障、科学评估劳教人员改造效果等方面入手，解决“首要标准”落实过程中存在的问题。     

民主革命时期中共纪念活动与马克思主义大众化

如何使具有西方文化背景的马克思主义被中国民众所普遍认同，并上升为中国革命的指导思想，是一个曾经考验中国共产党智慧的难题。中共纪念话语用通俗的语言和文字，用本民族的思维方式。阐述了马克思主义的理论构架和科学方法，展示了马克思主义理论的逻辑力量和行动魅力；吸引民众认识和了解马克思主义，激励民众选择和信仰马克思主义，从而为马克思主义大众化打开了一扇便捷之门。     

中国财政政策对居民消费需求的非对称效应——基于流动性约束视角下一个新的分析框架

政府运用财政政策扩大居民消费需求,除了需要科学抉择政策取向之外,政策力度和节奏的把握也非常关键。本文在Tagkalakis研究的基础上,首先提出了中国财政政策对居民消费非对称性效应研究的理论框架,然后建立财政政策冲击对居民消费影响的经济计量分析模型,利用1999—2009年中国省际面板数据估计了政府消费冲击、税收冲击以及预期可支配收入对居民消费的影响,并在此基础上进一步考察流动性约束在财政政策冲击对居民消费产生非对称性影响中的作用。实证结果表明财政政策冲击在好与坏两个时期之间对居民消费产生了显著的非对称性凯恩斯效应。其中在坏的时期,政府消费冲击与税收冲击对居民消费影响效应的绝对幅度相对较大。虽然国外理论界认为非对称性效应产生的原因复杂,本文认为在我国财政政策冲击对居民消费产生非对称性效应的原因中,流动性约束起到了非常重要的作用。另外,预期可支配收入因是否面临流动性约束而对不同类型消费者的消费需求影响发生方向性改变。     

中国大陆刑法学的精神现象：自大、自卑与自强

中国大陆刑法学的精神现象,同时也是中国大陆刑法学的学术心态,是我们应予以正视的一个问题。虽然精神现象或学术心态不是刑法学术的＂本体＂问题,但却直接影响乃至决定着中国大陆刑法学的＂本体＂的现状与前景。自大与自卑是中国大陆刑法学两种对立交错的精神现象,其所带来的是中国大陆刑法学的＂自弱＂。中国大陆刑法学者务实于中国自己的现实问题,并在解决中国自己的现实问题中形成自己的概念、范畴乃至命题,是中国大陆刑法学的＂自强＂之路。     

The Lord of the Rings and New Zealand: fantasy pilgrimages,imaginative transnationalism and the semiotics of the (Ir)Real

Peter Jackson's decision to make the Lord of the Rings and Hobbit films in his native New Zealand has given the country a major boost in tourism, but this has also become the paradigm of a new imaginative transformation of landscapes. The zeal with which many tourists visit these sites has similarities to the religious pilgrimage, not only in terms of the degree of enthusiasm invoked, but also in rituals of knowledge, ardour and “spiritual” envisioning. The global fantasy industry thus fosters alternative and dualistic engagements with the land that have come to contest the cultural and physical engagement with and even access to the land, as well as exacerbating the existing racial politics, particularly in smaller and more vulnerable nations such as New Zealand. What might be called the “(ir)realist” semiotics of fantasy – with its own cultural hegemony disguised as playful dualism – becomes a notable form of global remapping, often with positive benefits, but also with dangers to local cultures and identities.     

The ASEAN Regional Forum in United States East Asian strategy

This paper analyses the development of the US approach to the ASEAN Regional Forum (ARF), from 1991 onwards. It examines theories of why a superpower would participate in a multilateral security institution, and investigates the motivations for the attitudes and extent of participation of the George H. Bush, Clinton and George W. Bush administrations towards the ARF. It argues that, in the post-Cold War period and in the face of a rising China, US East Asia strategy has been geared towards retaining the American preponderance of power. Thus, the US has pursued a strategy of containment and deterrence centred upon the regional bilateral alliance structure. Multilateral institutions have been treated as a supplementary means of supporting the secondary strategy of engaging with China. However, the ARF is not viewed as one of the important institutions through which to fulfil this supplementary aim. Because it cannot deal with the key regional security issues, the ARF is seen as a low-stakes arena by Washington. But the paper concludes that US participation in the ARF may nevertheless be crucial in boosting the legitimacy of American security interests in the region, thus helping to safeguard US preponderance.     

警用执法记录仪使用效能及现存问题研究

随着越来越多的具有高科技含量的先进产品被纳入警用装备并投入使用以来,警用执法记录仪在一线公安工作中发挥了重要作用.节省警力资源,维护民警执法权益,提高工作效率的同时,仍然不能否认其在列装、配备、维护使用等多方面存在诸多问题,本文通过对警用执法记录仪的使用效能进行深入探讨,针对现存问题提出切实可行的解决办法.     

非法经营罪规制目的的预设与生成

非法经营罪在实践中存在扩张适用的倾向,被认为是“口袋罪”,对其司法适用有必要进行限缩。传统限缩方法是采取等价解释,但无法对该罪的规制目的予以合理解释。立法者在创制该规范之际并无明确的目的预设,且可能希望该罪的规范保护范围通过自发方式在司法中生成。在整体法秩序发展之中,基于经济、法治等外部系统的变化,非法经营罪除了要保障行政许可制度之外,还应越来越关注对市场调整方式的现实保障。行业性的合规制度作为市场调整的方式,将成为判断非法经营罪的根据。
