领导-成员交换(Leader-member Exchange,LMX)理论研究新进展

三十多年来,许多组织学者致力于上下级之间动态关系的研究,LMX理论则是这一研究领域的核心。以往有关LMX理论的研究大都在个体水平上考察LMX的主效应,近些年来,这一有关LMX理论的研究出现了一些新的动向。文章从测量工具、分析水平以及作用机制方面对LMX理论研究的新进展进行了概述,并进一步指出未来的研究应该从概念、测量方法、认知调节变量等方面加以改进。     

董必武与建国初期的法制建设

董必武是中国共产党的创始人之一。伟大的马克思主义者,杰出的无产阶级革命家,中华人民共和国的开国元勋。是新中国法制建设的主要奠基人和长期从事政法工作的国家领导人。也是党内坚决主张法治的第一人。董必武1975年病逝,其法制思想虽然未能在当时得到有效实施,但却对当代中国法治产生了深远的影响。     

试论工会干部应对突发事件的能力提升

突发事件是指在一定区域内突然发生的,规模较大且对社会产生广泛负面影响的,对公众生命和财产构成严重威胁的事件和灾难。在应对突发事件的过程中,工会组织要正确定位与党委、政府、企事业行政的关系,工会干部要努力提升应对突发事件的能力。     

Do Political Similarities Facilitate Interlocal Collaboration?

This research examines the extent to which political similarities—that is, homophily between political actors at the local level—affect patterns of interorganizational collaboration in an emergency response situation. While the field of emergency management has focused on implementation‐oriented arrangements among key stakeholders, few studies have systemically investigated the creation and development of interorganizational collaborations led by political actors, especially following catastrophic events. The analysis reveals that a dyadic tie with political homophily boosts local responders’ ties with other agencies during emergencies. Findings indicate that political solidarity, formulated by chief elected officials of municipalities and council members, can broaden the scope of interorganizational collaboration by mitigating institutional collective action problems at the local level. This research presents a critical recommendation for emergency managers that interlocal collaboration for timely response to a disaster is attributable to political similarities that facilitate frequent interlocal interactions through formal and/or informal agreements.     

Picture–text congruence in translation: images of the Zen master on book covers and in verbal texts

The study aims to demonstrate how cover pictures and verbal texts are congruent with each other in presenting the Zen master Huineng in two English translations of the Platform Sutra. The focus is on the interpersonal/interactive meanings and the analytical tools adopted are systemic functional linguistics and Kress and van Leeuwen’s visual social semiotics. Results show that the visual techniques employed to depict Huineng on the book covers are in consistency with the verbal choices adopted to present Huineng in the translated texts. While the medium to close shot and eye-level angle complement the choice of speaker-plus “we” as dominant interactive subject person, and qualified statements and polite suggestions/commands in Wong’s translation, the very long shot matches the use of speaker “I” and addressee “you”, and categorical statements and direct commands in Cleary’s translation. In this way a consistent image of Huineng is presented in each translation: friendly and willing to be close to the viewer/audience in Wong’s translation, but authoritative and distant in Cleary’s translation.     

《监狱法》缺陷的另类解读——以罪犯服刑能力为视角

《监狱法》的适用为我国改造罪犯、保障人权提供了法律保障,然而《监狱法》也存有一些立法上的盲点,例如对服刑能力的规定就是如此。服刑能力是罪犯接受刑罚惩罚的能力,对一个具备完整服刑能力的罪犯实施惩罚是符合正义的基本要求的,但是,对于一个服刑能力有缺损的罪犯实施强制性改造则是非人道的、非正义的。我国对服刑能力的研究还处于起步阶段,立法上还有许多空白之处,这就使得服刑能力成为刑罚改造实践中的一个盲点。     

Attacin-Thanatin杂合抗菌肽的融合表达及其菌内抑菌活性

构建杂合抗菌肽Attacin-Thanatin(简称mAT)融合表达重组菌株,对其在大肠杆菌系统中的表达特性及其融合表达产物的菌内抑菌活性进行了研究.将mAT重组表达质粒pET-mAT(pe)依次转化宿主菌E.coli DH5a、BL21(DE3)、Rosetta-gamiTM(DE3)pLysS,采用IPTG诱导表达;优化筛选该抗菌肽的敏感菌株、IPTG浓度、宿主菌诱导起始浓度等,初步建立了抗菌肽菌内抑菌活性检测方法,用于研究该杂合抗菌肽的体内抑菌活性.SDS-PAGE分析结果显示,宿主菌Rosetta-gamiTM(DE3)pLysS可获得表达的融合产物,而E.coli DH5α、BL21(DE3)经IPTG诱导后未检测到目的条带;优化结果显示,以E.coli DH5α宿主菌、IPTG工作浓度0.1 mmol/L、起始诱导菌浓度D600nm值0.3为检测抗菌肽菌内抑菌活性的最佳条件;mAT融合表达产物抑菌活性的检测结果显示,宿主菌被本身所表达的杂合抗菌肽融合蛋白所抑制,增殖速度放缓.利用Rosetta-gamiTM(DE3)pLysS有效融合表达mAT并初步建立的抗菌肽菌内抑菌活性快速检测方法为进一步研究mAT奠定了基础.     

立法语言叙事分析

法律文本是立法语言的编织物。从语言的功能来看,法律就是立法者通过文字将自己的意志施加给对象的意义描述系统;从叙事学的角度看,以语言为物质外壳的立法文本和立法行动本身具有"叙事"的特征。立法语言叙事最终体现的是立法者的权力意志。在立法实践中,如何恰当地控制和使用叙事的手段,从而为立法文本的完善提供可能,是我们进行叙事分析的初衷。     

程序正义及其局限性

程序正义是现代法的程序结构派生出的一种伦理形态 ,其本质为程序之中的伦理、非人格化的伦理、相对化和形式化的伦理、程序化的制度伦理。现实当中的程序正义是选举、司法以及立法、行政管理正当化的观念基础 ,宪政民主体制的伦理内涵。然而 ,程序正义之不幸在于其代表的乃是强者的正义 ,因而对弱者的权利保障是宪政民主体制不可缺少的组成部分。
