我国新《刑事诉讼法》引入了"有专门知识的人"这一概念,并赋予了其准鉴定人的法律地位。通过对"有专门知识的人"与鉴定人、证人的比较研究",有专门知识的人"出庭意见的证据种类归属问题有待进一步解决,以及相关制度有待进一步完善。

信任与冲突:基于社会管理格局中政府角色认同的理论分析

在社会管理格局中,信任是公众与政府之间如何互动的一种反映。它包含两种形态:一种是信任连续谱上的分散分布,另一种是信任连续谱上的集中分布。社区居民在政府强势面前,会选择自己的特有行为方式—不明确表达、欺骗、讨价还价、抗争—来诠释他们与政府的信任冲突。政府角色认同获得的信任建构应该塑造两种制度化的机制:一个是基于平等主体的压力机制,另一个是基于制度化信任资源提供的激励机制。
