Conditions not to Dispute Wills and the Inheritance (Provisions for Family and Dependants) Act 1975

In this article, the author reviews the recent decision of the HighCourt in In the Estate of Nathan Deceased [2002] N.P.C. 79, TheTimes 6/4/02, relating to the validity and effect off conditionsnot to dispute wills (i.e., gifts by will on condition that thebeneficiary does not seek to challenge the will) and how such conditionsaffect claims made under the Inheritance (Provision for Family andDependants) Act 1975. The decision in this case reveals a considerabletension between the principle of testamentary freedom and the aims andoperation of public policy in this area of the law. In the article, theauthor maps out the changes which will have to be made in statements ofthe law in leading text-books relating to conditions not to disputewills and further argues that certain dicta in the case suggest that theHigh Court has now gone too far in preferring testamentary freedom overpublic policy, opening a door which may yet permit the triumph ofconstructive fraud in some cases.     

Suicide by band saw

Suicidal injuries caused by power tools have rarely been reported in the literature. The case of a 37-year-old white male schizophrenic patient who sustained a fatal self-inflicted neck injury from a band saw, while engaging in occupational therapy, is presented. Unusual features of this type of injury as noted at postmortem examination were the extent of the wound, the absence of hesitation injuries, and the presence of grease wipe, bone dust, and sawdust within the wound.     

Correlates of loneliness in midadolescence

The present study was designed to assess the relationship between adolescent loneliness and the following factors commonly associated with adult loneliness: attributional style, self-esteem, social anxiety, and social skills. Subjects were 186 ninth-grade students (107 males and 79 females) who were asked to complete seven different paper-and-pencil measures. Data were analyzed by calculating separate stepwise multiple regression equations for the total sample, males and females. Three significant predictors were found for the total sample: student social skills rating scale, self-esteem, and the perception of stability in interpersonal situations (attributional style). A different pattern of predictors emerged for males and females. Loneliness could be predicted for males from three variables: low self-esteem, the perception of uncontrollability in noninterpersonal situations, and self-perceptions of poor social skills. The best multiple predictors of loneliness for the females were self-perceptions of poor social skills, high social anxiety, and stable attributions for interpersonal situations.This study is based on a master's thesis submitted by the first author to Wake Forest University, May 1986. ‘“Keeping Tabs” on Coalition Partners’: a Theoretically Salient Case Study of Lithuanian Coalitional Governments

Portfolio allocation raises the potential for de facto abdication on a broad range of policy issues among coalition partners. Recent scholarship has addressed how parties in governing coalitions ‘keep tabs’ on each other in order to avoid such abdication. Two mechanisms have been identified: junior ministerial appointments and chairs of parliamentary oversight committees. We argue that the former is the most common method for intra-coalitional oversight in the Lithuanian parliament and that a combination of the two appears to be employed for monitoring the activities of the most important ministries. We conjecture that dependence on junior ministerial oversight is more likely among coalition partners in less institutionalised parliaments.     

Redefining the roles of environmental NGOs in Africa

The article summarises issues identified in a study undertaken on behalf of the HIVOS Foundation of the Netherlands and the Netherlands Ministry of Foreign Affairs Development Division, which included a field study of 45 environmental NGOs in seven African countries. This generated an institutional database to support the aid strategies of the agencies commissioning the research, and forms the basis of an analysis of some of the broader issues concerning the role and behaviour of various types of NGO.     

Constituency campaigning in parliamentary systems with preferential voting: Is there a paradox?

This paper sets out to show whether constituency campaign effects exist, particularly in the context of a preferential electoral system such as Australia's. Data from the 1993 Australian Election Study suggest that, despite the best efforts of the candidates, local campaigning has a very limited impact on the vote. The paper considers a range of possible explanations for this limited impact: displacement, MPs' perceptions of their role, sources of campaign information, the importance of party labels in Australia, party discipline. It concludes with an explanation for the apparent paradox of why candidates bother campaigning when it does not make a difference to their vote.
