党的十六届四中全会提出"构建社会主义和谐社会"的执政理念,公安高等院校的学生管理教育工作也必须着眼时代要求,紧密联系工作实际,创新管理机制,增强法治意识,注重人文关怀,维护好学生的正当权益,充分发挥学生的积极性和主动性,开创和谐的学生管理教育工作新局面,为构建社会主义和谐社会做出应有的贡献.     

EU Security Strategy

The European Security and Defence Policy (ESDP) comprises an important part of the EU's Common Foreign and Security Policy (CFSP). The aim of ESDP is to strengthen the EU's external ability to act through the development of civilian and military capabilities for international conflict prevention and crisis management. In December 2003, the EU adopted its first European Security Strategy (ESS). Ever since then, the implementation of the ESS has been regarded as one of the biggest challenges for the EU in CFSP/ESDP matters. Although much progress has been made in its independent security and defence-building process, EU still faces serious problems and difficulties in this policy area. This paper tries to examine these recent developments, assess their impacts in regional-global security, and analyze existing problems and future trends. Finally, the author also examines EU-China engagements in recent years and explores possibilities for their future cooperation in the area of international security.     

An Analysis of Donald Trump's Political Personality Traits and Policy Orientations

As a political leader,US President Trump's personality traits affect his policy orientations and current US foreign policy.The authors analyze Trump's personality in several categories-uninhibited and capricious,dynamic and capable,profit-orientated and self-centered,competitive and persistent,positive and extraverted.The traits of breaking traditions,skill at strategic deception and negotiation,action-motivated implementation,intuitive decision-making,pursuit of respect and interest exchange,and vengefulness will shape his policy and behavioral orientations.Initial study shows Trump to be a political leader with positive personality traits and double-sided dimensions.The analysis offers insight toward understanding the new US executive and his policy direction.     

民国时期的刑法适用

刑事法治的实现不仅要有优良的刑法典,而且也要有公正、及时等的刑法适用。民国时期,效仿西方的刑法典制定了优良的刑法规范,由于各方面条件的限制,其并没有很好地适用到社会现实当中。其原因是多方面的,既有社会政治方面的原因,也有刑法典本身的问题。长期缺乏安定的社会环境、不完善的司法体系、不发达的法学教育和超前的刑法立法影响了民国时期的刑法典的适用。     

中孟经贸关系的现状与前景

2010年是中孟建交35周年,也是“中孟友好年”,对两国关系的发展有着特殊意义。两国最高层领导进行了互访,经贸关系持续升温,呈现出良好的发展态势,贸易额有望突破50亿美元,当然在两国经贸发展的过程中也日益凸显出一些问题,但两国经贸关系发展的总趋势是积极、乐观的,大有潜力可挖,值得期待。     

中印经济比较的理性思考

中印经济发展迅速，令世界瞩目。但中国经济增长速度大大快于印度，这是由于中印经济改革的不同轨迹、两国经济发展的环境差异、资本形成与经济结构等原因所致。两国经济发展潜力也有差异，两国未来经济竞争力主要取决于两国经济改革是否深入。     

德法与欧盟差异性一体化

差异性是欧洲一体化的显著特征。回顾欧盟差异性一体化发展演变过程,不难发现德国和法国发挥着十分重要甚至是决定性的影响。随着欧洲一体化的发展,德法两国的政治家认识到成员国不可能以同样的速度在所有政策领域同步前进,因此率先倡导差异性发展。德法还发起相关讨论,推动了差异性一体化的制度化发展。德法在差异性一体化问题上也存在一些认知差异,从中折射出两国对欧洲一体化未来发展方向的分歧。     

戏曲电影中唱腔设计著作权的保护——评黄梅戏电影《天仙配》案

通过对黄梅戏电影《天仙配》唱腔设计著作权侵权纠纷案的评析,论证了戏曲唱腔设计的著作权保护问题,以及电影作品著作权行使的特殊规则。建议通过司法解释的方式妥善处理跨越计划经济和市场经济时代的戏曲演员在戏曲电影出版发行中的经济利益问题,并建议修改《著作权法》来明确电影演员的权利保护问题。     

继承权公证有关问题的探讨

(外)孙子女是否属于《继承法》第16条所谓“法定继承人”,在现行立法框架下殊值讨论。鉴于(外)孙子女仅仅享有代位继承权,而我国立法对代位继承又采用“代表权说”,因此该权利应只被视为法律对(外)孙子女的一种特殊保护,与法定继承人所享有的法定继承权在性质上截然不同。所以,(外)孙子女不属于《继承法》第16条所谓“法定继承人”。
