公证债权文书执行审查程序与破产债权确认之诉的交错与区隔 ——以重庆莱卡斯贸易有限公司破产债权确认纠纷案为视角

具有强制执行效力的公证书确认的债权进入执行程序后,债务人进入破产清算的,围绕债权产生的争议,在规范层面上,存在着公证债权文书执行审查程序与破产债权确认之诉这两种不同的争议解决程序,然而这两种程序性质迥异,相互排斥、无法并行。为协调两种程序之间的关系,应当以裁定受理破产申请与裁定中止执行这两个时间节点为界,对这两种程序的适用范围进行区隔,分别确定两个程序的不同规制范围。     

经理与股东关系新论 --基于人力资本和公司契约的理论阐释

传统的公司法理论将公司经理与股东的关系界定为代理关系,公司法以此为基础建立了公司经理法律制度.但是随着现代公司股权日趋分散以及知识经济的发展,基于代理关系设计的股东对经理的监督制约机制已经失灵.代理理论不仅对现实中的"经理革命"浪潮无所适从,还对经理作为公司核心人力资本所有者的地位熟视无睹.因此,有必要重新界定公司经理与股东的关系.公司契约理论和人力资本理论为此提供了新的视角.将公司经理与股东之间的关系界定为契约关系,更有利于构建回应"经理革命"和知识经济的公司经理法律制度.

2 0世纪至 2 1世纪 ,加拿大侵权法发生了根本性的变化。过失侵权理论在侵权法中逐渐占据中心地位 ,围绕着过失侵权责任的建立、过失侵权责任的扩展、侵权规则的一般化和融合、侵权法的赔偿及损失分配政策的演变 ,以及其他法律的和非法律的可选择机制对侵权法的削弱等问题 ,百年来加拿大侵权法确立了过失侵权责任为主线的侵权法模式。     

Fast Multiplexed Polymerase Chain Reaction for Conventional and Microfluidic Short Tandem Repeat Analysis

Abstract:  The time required for short tandem repeat (STR) amplification is determined by the temperature ramp rates of the thermal cycler, the components of the reaction mix, and the properties of the reaction vessel. Multiplex amplifications in microfluidic biochip-based and conventional tube-based thermal cyclers have been demonstrated in 17.3 and 19 min, respectively. Optimized 28-cycle amplification protocols generated alleles with signal strengths above calling thresholds, heterozygous peak height ratios of greater than 0.65, and incomplete nontemplate nucleotide addition and stutter of less than 15%. Full CODIS-compatible profiles were generated using the Profiler Plus ID, COfiler and Identifiler primer sets. PCR performance over a wide range of DNA template levels from 0.006 to 4 ng was characterized by separation and detection on a microfluidic electrophoresis system, Genebench-FX^™. The fast multiplex PCR approach has the potential to reduce process time and cost for STR analysis and enables development of a fully integrated microfluidic forensic DNA analysis system.

公共政策变迁是人类社会基本的正式制度变迁模式,是围绕集体行动而开展的自发的或通过人为安排的秩序演进过程。政策变迁除了呈现为政策时滞、政策博弈、政策演进三个结构性逻辑外,还表现为政策失效、政策创新、政策均衡三个阶段性逻辑。任何一项公共政策的变迁都可能无法回避均衡—失效—创新—均衡这种方程式循环。因此,研究公共政策变迁的过程理论对于理解和掌握政策变迁的内在规律具有重要的理论意义和应用价值。     

Gendered Solutions to the Care Gap Issue in Iceland

Iceland has for some years enjoyed an international reputation as one of the most gender-equal societies in the world. It has also received a fair amount of international attention for an innovative approach to making parental leave compatible with gender equality by dividing the period into three equally long parts with non-transferable periods reserved for both parents. Still, there is a fairly long period that needs bridging from when parental leave ends and public day-care for children begins. During this intervening period parents have to find their own solution for childcare. We interviewed Icelandic parents about their use of parental leave and the bridging of the care gap period and argue that this gap is a major hindrance in the realization of the gender equality goals of the law on parental leave. We also note that unequal division of parental leave is generally not considered to violate the ideal of gender equality.

中国提供全球卫生公共产品的路径分析——以中国援助西非国家抗击埃博拉疫情为例

2013-2016年西非埃博拉疫情的爆发和流行凸现了全球卫生公共产品供给的严重不足。面对西非国家防控埃博拉疫情突发的紧急需求,中国政府予以高度重视并积极从多个方面提供全球卫生公共产品——中国医药专家全力参加埃博拉病毒诊断试剂和治疗药物等的研制,中国政府向多个西非国家提供紧急物资和资金援助,同时支持和参与以世界卫生组织和联合国为核心的国际公共卫生治理多边体系。然而,从提供全球卫生公共产品的角度看,中国国内防控传染病的能力尚有待提升,中国非政府组织和企业参与国际传染病防控行动的意愿亟需引导和鼓励,中国对国际公共卫生治理多边体系的参与度和贡献还应进一步提高。由此,中国在全球卫生治理领域的领导力和国际声誉才会得以提高和彰显。
