Potential impact of the Draft Money Laundering Regulations 2007 on trusts

Representative bodies, including the Law Society of Englandand Wales and the Society of Trust and Estate Practitioners,have raised concerns on the Draft Money Laundering Regulations2007 released on 22 January. They are intended to implementthe Third European Money Laundering Directive in England. However,many are fearful about the impact of Part 2 of the Draft Regulationswhich deals with customer due diligence (CDD) and, in particular,how the requirements will apply to trusts.     

Positive Resolution of Childhood Sexual Abuse Experiences: The Role of Coping,Benefit-Finding and Meaning-Making

Resolution of the trauma of childhood sexual abuse (CSA), and the current adjustment of 60 adult female CSA survivors were explored through qualitative and quantitative analyses of their coping strategies, perceived benefits, and meaning-making attempts. While the majority of the women (87%) perceived at least some benefit resulting from coping with the CSA experience, many (29%) found it impossible to make any meaning of their trauma. Specific benefits that were associated with various aspects of positive adjustment (marital satisfaction, better physical health, less isolation) included improved relationships with others, religious or spiritual growth, and improved parenting skills. Some perceived benefits were actually associated with a negative outcome. Increased knowledge of sexual abuse was associated with more isolation and lower marital satisfaction. When positive meaning could be derived from the coping process, the women reported less isolation. Avoidant coping was strongly associated with more depressive symptoms and poorer resolution of abuse issues. Results highlight the importance of considering coping strategies and cognitive restructuring efforts in designing therapeutic interventions with this population. Closing the Gaps: Plaintiffs in Pivotal Sexual Harassment Cases

When he wrote Debtors in Court almost 30 years ago, Herbert Jacob laid the foundation for the legal mobilization research that has flourished in recent years. In arguing that litigants were political actors, Jacob showed that their social identities and Communications networks influenced their decisions to use the power of the law to vindicate their interests. This paper builds on Jacob's original insights to analyze the origins of the claim for sexual harassment as a Title VII violation. By focusing on the women who filed those claims, the paper examines the interaction of class, gender, and race that created social distance between the women and their harassers and employers. This distance made informal resolution of their disputes impossible, requiring the intervention of third parties. In addition, their Communications networks led them to attorneys able to generate and expand the new claim for sexual harassment. This analysis of a particular moment in legal history reveals the potential political significance of private litigation.

Implementing children’s right to be heard: Local attenuations of a global commitment

A critical challenge for human rights and human security alike turns on diminution of subject audibility and voice and the reduction of rights-bearing subjects to mere referent objects of security. Owing in part to inadequate theorization of child/youth subjecthood, this problem is especially acute where the rights and security of young people are at issue. Though the UN Convention on the Rights of the Child makes specific provision for recovery of the voices of children and youth, this may be frustrated at implementation in local settings. Moving beyond the Global South, where this problem has been more readily acknowledged, this article inquires into practices that undermine child/youth rights by reinforcing the subject/object positions of protector/protected in ways that disallow young people’s articulations of their best interests and security needs. Spurious presumptions about young people’s (in)capacity for independent subjecthood as well as emergent rhetorical technologies of silencing and voice-denial are identified.     

The COVID Cash Transfer Study: The Impacts of a One-Time Unconditional Cash Transfer on the Well-Being of Families Receiving SNAP in Twelve States

There is growing interest in the use of unconditional cash transfers as a means to alleviate poverty, yet little is known about the effects of such transfers in the U.S. This paper reports on the results of a randomized controlled study of a one-time $1,000 unconditional cash transfer in May 2020 to families with low incomes in 12 U.S. states. The families were receiving, or had recently received, Supplemental Nutrition Assistance Program benefits. We examine the impact of the cash transfer on five pre-registered outcomes (material hardship, mental health, parenting, child behavior, partner relationships) and several secondary outcomes (hardship avoidance, consumption, employment, benefit use). We find no statistically significant effects (powered to detect effects of 0.09 standard deviations) of the cash transfer on any outcomes for the full sample. In pre-specified exploratory analyses, we find significant reductions in material hardship (-0.17 standard deviations) among families with less than $500 of earnings in the previous month, roughly the bottom 50 percent of monthly earnings for the study sample.
