No consensus yet exists on how to handle incidental findings (IFs) in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are findings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed.  相似文献

We studied mediation practice in the South African construction industry by surveying sixty-three mediators. We found that mediators are more intent on resolving disputes for the parties than on assisting the parties to find their own settlements. In addition, we found that greater emphasis by parties to the dispute is placed on technical expertise, authority, and a clear understanding of the matter in dispute than on moving the parties toward an in-depth understanding of each other's perspectives. We conclude that mediation practice in the South African construction industry is not consistent with generally accepted principles of mediation. We also argue that the fragmented and potentially adversarial traditional procurement system predominantly used in South Africa, together with the inadequate institutional response in promoting mediation as a preferred dispute resolution method, is encouraging mediation to develop in this way. This is cause for concern, not only because this practice represents a departure from the underlying philosophy of mediation — dialogue aimed at amicable and long-lasting solutions that are in everyone's best interests — but because it is incompatible with the Southern African worldview concept of ubuntu .  相似文献

The concept of emotional labour describes the management of emotions as part of everyday work performance. Much of the research in this field has been in relation to jobs in the service sector where (mostly female) employees are required to shape their own feelings in order to make customers or clients feel at ease, comfortable or happy. There has been relatively little attention paid to the importance of emotional labour in professional occupations. This paper examines the emotional labour of magistrates in court. Magistrates must often regulate their own emotions and those of some court users, many of whom are not legally represented and who express a variety of emotions, including anger and distress, and experience social problems that may elicit emotions or emotional responses from the magistrate. The paper reports findings from interviews with over 40 magistrates throughout Australia and begins to address the significance of emotional labour for this branch of the judiciary.  相似文献

New Terrorism is increasingly deploying women in the field as combatants. Female suicide bombers have proven to be highly effective, precisely because of the persistence of gender stereotypes in target societies. Women terrorists convey a powerful message of political seriousness, heighten the sense of intimidation and threat, and attract greater mass media attention—all key strategic objectives of New Terrorism. Gender stereotypes are also at work in explanations for women's recourse to terrorist activism. Such stereotypes simplify complex motivations and either overvalue or undervalue women's agency. The net result of this stereotyping is that women end up worse off individually and collectively, domestically and internationally. The lives of women in geopolitical hotspots have become more precarious, and the valorization of women terrorists undermines the quest for women's emancipation in fundamentalist cultures. In Western democracies, paternalistic outrage at women's subordination under fundamentalist regimes may have initially served as a dubious justification for military and other interventions, but the involvement of women in terrorist activism now risks reinforcing an even more dangerous “clash of civilizations” thinking. One effect is to undermine the demands for greater gender equality in Western democracies as well as indirectly support the war on women political agenda domestically.  相似文献

Young people with cognitive disabilities (YPWCD) are overrepresented as offenders in the criminal justice system. However, most existing research on this topic examines overrepresentation in courts and corrections rather than at the police gatekeeping stage of the criminal justice process. Furthermore, while the views of other groups have been documented, the perspectives of service providers – who often bear witness to YPWCD’s interactions with police – have yet to be examined. This research addresses this gap by analysing qualitative interviews with service providers from Queensland, Australia, using the three most common theoretical explanations for the overrepresentation of PWCD (the susceptibility, differential treatment and psychosocial disadvantage theses) as an analytic framework. A number of implications emerged from the study. There is a need to take a critical and intersectional lens to YPWCD’s experiences, as well as to equip police to work with YPWCD to de-escalate interactions with this group.  相似文献

Several Canadian and international scholars offer commentaries on the implications of the COVID-19 pandemic for governments and public service institutions, and fruitful directions for public administration research and practice. This first suite of commentaries focuses on the executive branch, variously considering: the challenge for governments to balance demands for accountability and learning while rethinking policy mixes as social solidarity and expert knowledge increasingly get challenged; how the policy-advisory systems of Australia, Canada, New Zealand, and United Kingdom were structured and performed in response to the COVID-19 crisis; whether there are better ways to suspend the accountability repertoires of Parliamentary systems than the multiparty agreement struck by the minority Liberal government with several opposition parties; comparing the Canadian government’s response to the COVID-19 pandemic and the Global Financial Crisis and how each has brought the challenge of inequality to the fore; and whether the COVID-19 pandemic has accelerated or disrupted digital government initiatives, reinforced traditional public administration values or more open government.  相似文献
