中国—东盟自由贸易区成立以来的成绩、问题及对中国—东盟关系的影响

文章总结了中国—东盟自由贸易区(CAFTA)建成一年多时间来取得的成绩,包括推动双边的贸易和投资,加深区域融合,促进中国省市对东盟市场的了解等；指出了存在的问题,如双方对CAFTA的“热情”不平衡,贸易不平衡,一些东盟国家对中国仍有担忧,中国企业对CAFTA仍缺乏了解等.文章认为,CAFTA的建成进一步密切了中国与东盟的经济关系,但双方应加强互信合作,以达到双赢目的.     

大数据背景下打击中缅边境网络赌博犯罪研究

在中缅建交70周年之际,中缅友谊不断深化,携手推动构建更为紧密的中缅命运共同体。随着网络的高速发展,不法分子利用虚拟网络空间的隐蔽性和跨国性,基于中缅两国边境线长、无天然屏障的特点,在缅甸境内发展网络赌博,以“国外高薪劳务”“免费旅游”“无息贷款”和“境外赌博”诱骗中国公民到境外,非法拘禁或绑架残害受骗者,以勒索受骗者钱财,严重影响社会和谐稳定发展。本文采用大数据技术分析和调研一线翔实数据和资料,提出在大数据背景下如何变革侦查模式,建立健全预警平台,完善跨区域警务合作,打击网络赌博违法犯罪,促进中缅双方的经济和社会和谐稳定发展。     

台湾师范大学就业指导及其对大陆的启示

中国大陆经济发展进入新常态,大学生就业面临就业总量不确定及就业结构化矛盾深化的可能性,大陆高校就业指导工作创新问题亟待解决。本研究以台湾师范大学为例,概括其健全制度建设及规范人员准入机制、贯穿大学四年的就业指导工作指南、以生涯辅导为核心的特点。基于此,大陆高校可借鉴台湾师范大学,从机构功能完善、师资队伍建设、精准服务设计、科研提升发展四个方面提升生涯辅导的实效性。

情谊行为的法律分析——以法律对情谊行为之介入为视角

情谊行为,又称好意施惠行为,是指人类社会的情感交际活动和互惠互助活动。通常情况下,情谊行为的双方当事人主观上并无设定法律上权利义务关系之效果意思,故部分观点认为其不属于法律的调整范围,而属于道德和伦理的调整范围。但是从司法实践的角度观之,情谊行为并不完全等同于道德行为,也不一定不会引起法律后果,如情谊行为引起的合理信赖保护与侵权责任。从大陆法系与英美法系对情谊行为的相关制度与判例中可以发现,法律会介入情谊行为并产生某种法律后果。而这种介入有别于其对法律行为的介入,法律对情谊行为的介入有相应的限度。若能将法律对情谊行为之介入体系化与类型化,或能成为又一个"法律上之发现"。

In the past few centuries, the Islamic revival movement has been widely spreading in the world. Over the past dec- ades, the Islamic revival trends and movement in the Middle East and other regions can be roughly divided into conservative, moderate and radical factions. The radicals are advocating implementing religious extremism. The modern Muslim extremists and their terrorist activities have not only been undermining the international security, but also posing a great threat to China＇ s national security. To cope with the threat of terrorism, the international community should not only make military strikes, but also take action on the ideological level.
