Trying to build computerprograms that can assist the practicing lawyerin solving concrete cases is scientificallychallenging and financially attractive. So far,the practical results of such endeavors arerather modest, but that may change. This paperexamines the possible impact in the future ofadvanced advisory software on the semantics andpragmatics of law. Two kinds of computerprograms are discussed, viz., expertsystems and dialogue models. It is argued thatsuch systems may affect adjudication in someimportant ways, and that jurists shouldtherefore develop a more critical attitudetoward the use of such systems. Furthermore, itis argued that the widespread idea that the useof computers leads to more objectivity is onthe whole mistaken. As to the role of computersin legal decision making, the final question isnot: can they do it? But: do we want to let them doit? All this does not mean, however, thatjurists should turn away from ArtificialIntelligence and Law. On the contrary,developments in that field can be highlystimulating for legal theory and legal semiotics. 相似文献

In the Netherlands, active citizenship in the context of urban regeneration of deprived neighbourhoods seems to have evolved into ‘entrepreneurial citizenship’. The concept of entrepreneurial citizenship combines top-down and bottom-up elements. National and/or local governments promote an ideal citizen with entrepreneurship skills and competencies to create more responsible and entrepreneurial citizens’ participation in government-initiated arrangements. At the same time, bottom-up behavioural practices from citizens who demand more opportunities to innovatively apply assets, entrepreneurial skills, strategies and collaboration with other stakeholders are initiated to achieve their goals and create societal-added value. The aim of this paper is to better understand the origins of ‘entrepreneurial citizenship’, and its meaning in the Dutch context of urban regeneration. To do this, we will review the relevant international literature and combine insights from studies on governance, active citizenship, social and community entrepreneurship and urban neighbourhoods. We will also analyse how entrepreneurial citizenship can be locally observed in the Netherlands as reported in the literature. 相似文献

Using two different data sources—municipal level data and individual data—we consider several hitherto unexplored aspects of the relationship between voting technology and election outcomes. We distinguish between introductory and permanent effects of electronic voting, and between national and municipal elections. We test for a possible asymmetry between the effect of moving from paper ballots to electronic voting, and vice versa, and we control for polling station density. We find a positive but temporary effect of electronic voting on voter turnout, a negative effect on the fraction of residual votes, and no effect on the share of left wing parties. 相似文献

The present study explores the associations between three types of peritraumatic reactions (dissociation, distress, and tonic immobility) and posttraumatic stress disorder (PTSD) symptoms in a sample of 125 victims of interpersonal violence who had applied for compensation with the Dutch Victim Compensation Fund (DCVF). In addition, the confounding roles of malingering and fantasy proneness are examined. Results indicate that tonic immobility did not predict PTSD symptom levels when adjusting for other forms of peritraumatic reactions, whereas peritraumatic dissociation and distress did. However, after the effects of malingering and fantasy proneness had been controlled for, malingering is the only factor associated with increased PTSD symptomatology. Implications for policy practice as well as study strengths and limitations are discussed. 相似文献

This article is about the state of multiculturalist politics in the Netherlands. It assesses the popular claim that a paradigmatic change has occurred in the Netherlands due to events such as 9/11 and the murders of Pim Fortuyn and Theo van Gogh. The article argues that although changes are significant, both in discourse and in practice, they must be viewed as part of a process of rethinking the relation between newcomers and the state that goes back as far as the end of the 1980s. Long-standing claims about the exemplary form of multiculturalism in the Netherlands were always ambiguous at least, or even hard to sustain. The article criticises the persistent idea that Dutch accommodating integration policies since the end of the 1970s are an extension of the historical tradition of 'pillarisation'. Only by going beyond this myth can we understand why recent changes are much less of a break with the past, and why multiculturalism was never accepted or practised as fully as has often been suggested in more stereotypical depictions of Dutch integration policy. 相似文献
