我国医疗损害赔偿案件法律适用问题研究报告

医疗损害赔偿案件法律适用的历史进程分为初步摸索阶段、行政法规主导阶段、向行政法规转型阶段以及法律适用混乱阶段;现阶段医疗损害赔偿案件呈现出数量逐年增多、审理周期长、纠纷解决机制多元性以及患方胜诉率较高等特征;在法律适用方面存在着将医疗损害案件划分为医疗事故和医疗差错、案由的二元化、适用法律的二元化、鉴定的二元化、赔偿标准的二元化、举证责任、当事人适格、诉讼时效及起算点等问题;解决医疗损害赔偿案件法律适用问题的途径是首先制定侵权责任法,确立医疗损害赔偿制度、之后制定专门的医疗损害赔偿法,统一规定医疗损害责任问题.正确适用法律对于切实保护医患双方的合法权益,构建和谐的医患关系,保证我国的医疗卫生事业健康有序的发展具有重要的意义.     

民事检察在民事诉讼中的空间及路径探讨

十多年的司法实践已经证明,民事检察对于维护司法公正与权威,救济当事人的受损权益发挥了不可替代的作用,同时,它所面临的困境也已严重制约着其职能的履行。对民事检察的改革与完善应当秉承宪法对检察机关的角色定位,围绕法律监督的主题进行,同时应当处理好检察权与诉权、审判权的关系,在合理的空间范围内加大民事检察力度,拓宽民事检察广度,实现其应有的法律价值和社会效果。     

检察机关在民事诉讼中的职权配置研究

作为国家的法律监督机关,检察机关参与民事诉讼是实现法律监督的重要途径和方式。应当明确检察机关在民事诉讼中具有多元化的参诉目的和不同的角色定位,明确检察机关可以以提起诉讼、参与诉讼和提出抗诉等多种方式参与民事诉讼,以便按照多元化的职权配置模式实现检察机关在民事诉讼中职权的科学配置。

This document establishes a final rule regarding possession, use, and transfer of select agents and toxins. The final rule implements provisions of the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 and is designed to protect public health and safety. In a companion document published in this issue of the Federal Register, the United States Department of Agriculture has established corresponding final rules designed to protect animal and plant health and animal and plant products.     

论我国仲裁证据保全权的分配

在仲裁实践中,证据往往会由于某种原因的存在而有灭失或今后难以取得的风险,因此在各国仲裁实践中,均须建立起合理的证据保全制度,而证据保全权如何分配是合理构建证据保全制度的关键.仲裁证据保全申请权应分配给当事人;仲裁证据保全执行权应分配给人民法院;在仲裁程序开始之前,仲裁证据保全的审查和决定权应分配给人民法院,在仲裁过程中,保全的审查和决定权应分配给仲裁机构,以此完善我国仲裁证据保全制度.     

A Social Psychological Perspective on Perceiving and Reporting Discrimination

This article reviews social psychological theory and empirical research on perceiving and reporting discrimination. The article begins with an examination of factors that affect whether individuals perceive themselves as targets of discrimination. We then turn toward addressing whether individuals who perceive discrimination are willing to report their perceptions, as well as the interpersonal consequences they might face for so doing. Throughout this article, we examine how endorsement of the meritocratic worldview shapes these discrimination-related processes. Finally, we conclude by noting the potential for important theoretical, empirical, and applied advances on discrimination scholarship that can arise from interdisciplinary collaboration among legal scholars and social scientists.
