Constitution, Court, Indian Tribes

We claim that the "constitution, and the laws of the United States which shall be made in pursuance thereof… shall be the supreme law of the land." But we also claim to recognize the sovereignty of Native American nations, the original occupants of the land. These claims—one to jurisdictional monopoly, the other to jurisdictional mu1tiplicity—are irreconcilable. Two hundred years have produced no resolution of the contradiction except at the expense of the tribes and the loss to non-Indians of the Indians' gift of their diflerence. This article explores the bear- ing of American constitutional law upon Native American tribes.     

Measuring the Performance of Community Organisations in Queensland and New Zealand

The need to measure qualitative outcomes is well documented. This article argues that despite this recognition many programs are still evaluated using unreliable numerical indicators. This has particular ramifications for community service programs that deal with the sharp end of social problems. While the New Zealand government has instigated a comparatively detailed approval standards, the Queensland government's community service guidelines are still applied almost on an ad hoc, case by case basis. Both New Zealand and Queensland performance indicators are directed towards process outputs, with a primary focus of government being centred on financial accountability. The satisfaction of the client remains the core responsibility of the service provider, but there is little assessment of how successful programs are in meeting individual requirements. This article suggests that there needs to be the development of a more collaborative relationship between governments and community service organisations, to ensure both financial and social objectives are fully realised.     

The dilemmas of legal mobilization: ideologies and strategies of mental patient liberation groups

The decision to participate in the legal process depends in part upon the ideologies of the potential participants. The ideology that has dominated the rights movement during the past two decades is what Stuart Scheingold describes as the myth of rights. But participation in litigation, including rights evolution litigation, has also been colored by other and sometimes conflicting ideologies. Thus the mobilization of legal resources can be seen as the ways participants in litigation cope with multiple ideologies.
This paper looks at the mental patient liberation movement in this way. That movement has been very much affected by a myth of rights ideology, as well as by a liberation ideology that is quite contradictory to the tenets of the myth of rights. The paper documents these ideologies, looks at the way the movement has tried to reconcile them, and shows how this problematic reconciliation affects the nature of mental health rights litigation.     

Ethnographic Methods in Criminological Research: Rationale,Reprise, and Warning

Use in criminological research of observation, semi-structured interviewing, and analysis of personal documents has been commonplace for more than a century. These research techniques can be employed to develop and test theoretical explanations and to examine the process of policy implementation. This paper briefly explicates how they were used in studies of the decision making and criminal careers of street-level thieves and hustlers, to test theoretical notions about the delegitimantion effects of white-collar crime, and to examine the implementation of a crackdown campaign by Australian tax authorities direct at crash transactions in the small building and construction industry. Investigations may profit, however, from awareness of recurrent challenges in the use of ethnographic methods before launching research of this type.     

Measuring trade strategy in the presence of non‐tradeables: Theory and some evidence for the Caribbean

This article models trade policies in the presence of non‐tradeables, and investigates trade strategy interventions and outcomes where the price of non‐tradeables endogenously adjusts to trade interventions. Trade regime bias and neutrality issues are examined within a three‐sector, open economy model. The theoretical framework is operationalised using empirical evidence for Trinidad and Barbados. The robustness of partial equilibrium measures of protection for classifying trade strategies is challenged and evidence on alternative general equilibrium or ‘true’ measures of protection is reported. ‘True’ or revealed trade strategies are shown to differ from those apparently intended by policy‐makers.
