This article is about legal mobilization by claimant groups seeking left-liberal reform in the United States. Drawing on a growing body of work in political science and legal studies, it takes an interpretive, legal-mobilization approach to one litigation-based reform effort: school finance litigation and education reform in Kentucky. In turn, this case study provides leverage for theorizing about legal mobilization and the role of law and courts in social reform. The article argues that current theoretical approaches either overlook or neglect the implications of important dimensions of legal mobilization by would-be reformers. Specifically, it highlights and explicates the meaning of two related themes: (1) legal translation, taken up here as legal framing and legal construction, and (2) the degree of coherence or fit between the legal and political components of reform projects that include both legal mobilization and extrajudicial strategies and tactics. This article suggests that the "degree of coherence" may have an important but underappreciated relationship to the overall success or failure of such reform projects. 相似文献

Abstract The use of informers is morally problematic for police institutions, for investigation managers, and for those individuals either who act as informers or who have daily responsibility for handling informers. This paper examines the moral issues concerning informers at each of these levels. Recourse to informers can be accommodated within Miller and Blackler's moral theory of policing. Within this context, criteria for the morally justifiable deployment of informers are proposed and supplemented with further proposed criteria for morally justifiable informer participation in crime. Morally justifiable recruitment of informers is also considered. Despite directly serving the purpose of policing, informers do not incur police professional obligations. 相似文献

There are billions of annual transactions between citizens and government; most of these are between citizens and local government. Both central and local government share the same target for electronic service delivery: 100% of key services online by 2005. In Northern Ireland, however, district councils are being left behind on the e-government agenda. The Northern Ireland Assembly, currently suspended, has no provisions or recommendations for local e-government, although many transactional services of interest to ordinary citizens are provided by local councils. The absence of a strategy for local e-government means that district councils are left to their own devices, and this contrasts with the rest of the UK. A snapshot of local councils is used to assess the extent of provision of electronic service delivery, highlighting examples of innovation, and indicating significant challenges for Northern Ireland local e-government during a period of suspended devolution. 相似文献
