Defense Management Challenges for the Next American President

The next American president will face a daunting list of national security problems, including a serious defense budget crunch. The budget crisis will be deepened by the global financial crisis, a tapering of supplemental funding associated with the wars in Iraq and Afghanistan, and the steady growth of military healthcare and other personnel costs. After six years of rapid defense budget increases, the Pentagon has lost the practice of matching strategy and resources. The next president will need to manage risk among investments in irregular warfare, counterterrorism, balancing new super powers, countering weapons of mass destruction, and traditional warfare. He will also need to begin to build non-military “soft power” capabilities outside of the Pentagon.     

Towards an EC directive on plant breeder's rights?

Legal context: Although ‘Brussels’ has established many Directivesand Regulations in the field of IP law during the last two decades,there is still no Council Directive on plant breeder's rights. Key points: The article first examines the current national plant varietyprotection laws in force in the EC Member States. It then focuseson some figures with regard to national applications and Communityapplications for plant breeder's rights filed in the years 2001–2005.Subsequently, it discusses a number of optional provisions laiddown in the 1991 UPOV Convention and it points out the manydifferences in national laws that result from this UPOV text.In particular, it draws attention to national differences withregard to the protection of products made directly from harvestedmaterial, the farmer's privilege, and the term of protection. Practical significance: The article concludes that national applications for plant varietyprotection still play a significant role next to Community applications.It argues that the establishment of a Directive would be worthconsidering, as the differences between the laws of the MemberStates lead to barriers to the free movement of goods and toa distortion of the conditions of competition on the commonmarket.     

COIN Machine: The British Military in Afghanistan

This article assesses the British military effort in Afghanistan looking at three key elements in the campaign: strategy, military operations, and the inter-agency “Comprehensive Approach.” We start by recognising the scale of the challenge that has faced the British: of all the provinces in Afghanistan, Helmand is the toughest to stabilize and secure. We then examine the evolution of all three elements above and find significant improvements in each: a flawed strategy has been corrected; the military have received more resources and become significantly better at COIN; and there is significant progress in the development of the inter-agency approach. In short, what the Americans will find in Helmand is a British COIN machine; a little creaky perhaps, but one that is fit for purpose and getting the job done. We briefly conclude on the prospects and the key to success: namely the development of a more coherent international strategy that accommodates the challenges posed by both Afghanistan and Pakistan.     

Sachverständigenhaftung des Immobilienmaklers wegen verletzter Aufklärungspflicht über die rechtliche Beschaffenheit eines WE-Objekts

Auch wenn den Immobilienmakler keine einer anwaltlichen Beratungst?tigkeit gleichkommende Aufkl?rungspflicht trifft, hat er gegenüber dem Auftraggeber (hier: Erwerber eines WE-Objekts) die versch?rfte Haftpflicht als Sachverst?ndiger nach § 1299 ABGB zu vertreten, da er eine qualifizierte Interessenwahrungs- und Aufkl?rungspflicht (hier zur Rechtsfrage, ob ein Dachboden WE-Zubeh?r zur Eigentumswohnung oder allgemeiner Teil des WE-Hauses ist) erfüllen muss. Verletzt er diese fahrl?ssig, schuldet er dem Auftraggeber Schadenersatz wegen Nichterfüllung des aufgel?sten Kaufvertrags.     

Aufteilung der gemeinschaftlichen Liegenschaftsaufwendungen gem § 32 Abs 1 WEG 2002 – auch für (noch) nicht errichtete WE-Objekte – nach dem Grundbuchsstand

Nach § 32 Abs 1 WEG 2002 sind die gemeinschaftlichen Aufwendungen für die WE-Liegenschaft einschlie?lich der Beitr?ge zur Rücklage von s?mtlichen Wohnungseigentümern nach dem Verh?ltnis ihrer Miteigentumsanteile – entsprechend dem Grundbuchsstand – zu tragen. Weil ein (noch) nicht errichtetes WE-Objekt (hier: ein Gesch?ftsraum) erst untergeht, wenn dessen unterbliebene Errichtung endgültig feststeht, führt seine blo?e rechtliche Existenz, dh mit einem im Nutzwertverfahren ermittelten und im Grundbuch einverleibten Mindestanteil samt untrennbarer Verbindung mit dem – tats?chlich nicht gebauten – WE-Objekt zur dem entsprechenden Kostentragungspflicht des Wohnungseigentümers nach § 32 Abs 1 WEG 2002. Wollte der WE-Verwalter von seiner gesetzlichen Pflicht abweichen, die gemeinschaftlichen Liegenschaftsaufwendungen nach dem gesetzlichen Aufteilungsschlüssel des § 32 Abs 1 allen Wohnungseigentümern vorzuschreiben, bedürfte dieser Akt als Ma?nahme der au?erordentlichen Verwaltung nach § 29 Abs 5 WEG 2002 iVm den §§ 834f ABGB der Zustimmung s?mtlicher Teilhaber. § 32 Abs 2 WEG 2002 (früher: § 19 Abs 1 Z 2 WEG 1975 in der Stammfassung) schlie?t mit der zwingenden Schriftform der einstimmigen Vereinbarung eine konkludente ?nderung des gesetzlichen Aufteilungsschlüssels aus.
