The history of international air carrier liability for passenger death and injury is long and complex, predating the Warsaw Convention of 1929. The intervening years have witnessed protracted political and legal battles involving airlines, governments and lawyers intent on securing, through global agreement, adequate protection for the industry, tax‐payers and passengers. Two decades of aviation terrorism have heightened the risks faced by travellers, many of whom are inadequately protected against personal ruin in the event of terrorist attack.  相似文献

Recent Public Record Office releases of British Foreign Office documents include diciphered diplomatic messages from several European capitals intercepted from 1919 onwards by a department of the Foreign Office called the Government Code and Cipher School (GCCS). These intercepts were called ‘bjs’ ‐ ‘blue jackets’, from the blue folders in which they were regularly delivered to a very few top government officials. This paper is based on bjs mainly from French, Italian, American and Turkish capitals and embassies during the autumn of 1922 when a genocidal war was being fought along the Black Sea southern coast between Greece and Kemalist Turkish forces under the future President, Ismet Inonu. What became known as ‘the Chanak Affair’ led the Powers perilously close to renewing hostilities terminated at the Armistice of 1919. Despite the attention given by Lloyd George, Curzon and Churchill to the implications of the bjs as to Turkish, French and Italian intentions, peace was established on the ground before the end of the year by Inonu and the British C‐in‐C, General Harington.  相似文献

Prosecution in England and Wales, traditionally private, was captured by the 'new police', creating an 'English tradition' unlike those of the rest of the United Kingdom. To overcome consequent problems, the Royal Commission on Criminal Procedure recommended the 'Philips principle', whereby investigator and prosecutor were separate, but co-ordinate, on which basis the Crown Prosecution Service was set up. However, the principle was in fact compromised by the 'English tradition', most obviously by permitting continued police prosecution. Moreover, the Serious Fraud Office, set up shortly thereafter, contradicted the principle. Yet, HM Customs and Excise addressed its serious problems by applying the principle. The CPS itself encountered difficulties flowing from the compromises. Reports (Runciman, Narey, Glidewell) recommended various devices, straining the principle, until the Auld Report recognised that reformulation was necessary, along the lines adopted elsewhere in the United Kingdom, that is, by recognising that there should be investigator subordination to prosecutor.  相似文献

Abstract

The backbone of Dutch criminal procedure is the case file including a large number of written records. In Dutch courts the focus is primarily on evaluation of written records. The written record of police interrogation is a mediated account of the interrogation itself. In this study we explore how individual differences in the production of written records by police officers affect the jurists' evaluation of the suspect's story and of the quality of the interrogation itself. In the first study, five police officers produced written records of one and the same interrogation on video of a denying suspect. In the second study, three of those written records are evaluated by jurists. They are asked to determine story acceptability of the suspect and procedural fairness of the interrogation. Findings show that a short and simple interrogation of a suspect results in written records that are quite different (Study I). It is further shown that these differences affect the jurists' evaluation of some of the core issues addressed in a criminal process (Study II). Implications of these findings are discussed as well as a number of possible ways to improve the current state of affairs.  相似文献

A statistical analysis of unemployment between 1956 and 1971 shows that the factors influencing it in Malta are similar to those for more developed countries: unemployment varied with demand deficiency and the opportunity cost of working. The absence of a secular change in unemployment for both sexes combined masked the secular increase for men and decrease for women; and other evidence supports the conclusion that women were being substituted for men in the labour force. Finally, the analysis of emigrants most likely to be in the labour force in Malta showed that the rate of emigration is also responsive to local labour market conditions, although not to the provision of social security for those of working age.  相似文献
