Lyndon Johnson woke up studying whip counts, went to bed reading the Congressional Record, and invested countless hours in between translating that political intelligence into a lobbying offensive. The result, famously christened “The Johnson Treatment,” remains the archetype practitioners and political scientists cite when appraising presidential leadership on Capitol Hill. Yet Beltway folklore aside, we know little about how LBJ helped forge winning legislative coalitions. Stepping back from the (countless) colorful anecdotes, this study offers a new and systematic look at Lyndon Johnson's lobbying. Specifically, after exploring theoretical models of presidential coalition building, we then investigate their operational tenets using original data on all President Johnson's contacts, with each member of Congress, in both chambers, for every day he was president.  相似文献

The right to data portability is one of the most important novelties within the EU General Data Protection Regulation, both in terms of warranting control rights to data subjects and in terms of being found at the intersection between data protection and other fields of law (competition law, intellectual property, consumer protection, etc.). It constitutes, thus, a valuable case of development and diffusion of effective user-centric privacy enhancing technologies and a first tool to allow individuals to enjoy the immaterial wealth of their personal data in the data economy. Indeed, a free portability of personal data from one controller to another can be a strong tool for data subjects in order to foster competition of digital services and interoperability of platforms and in order to enhance controllership of individuals on their own data. However, the adopted formulation of the right to data portability in the GDPR could benefit from further clarification: several interpretations are possible, particularly with regard to the object of the right and its interrelation with other rights, potentially leading to additional challenges within its technical implementation. The aim of this article is to propose a first systematic interpretation of this new right, by suggesting a pragmatic and extensive approach, particularly taking advantage as much as possible of the interrelationship that this new legal provision can have with regard to the Digital Single Market and the fundamental rights of digital users. In sum, the right to data portability can be approximated under two different perspectives: the minimalist approach (the adieu scenario) and the empowering approach (the fusing scenario), which the authors consider highly preferable.  相似文献

ABSTRACT

Scholarship on subsidiarity conducted since the nineteenth century has developed two strands of interpretation suggesting competing models of social organisation as far as the potential location of decision-making power is concerned. While this intellectual effort has mainly concentrated on political experiences in continental Europe, and gained further traction with the principle’s recognition in European Union law, the institutional architecture of Commonwealth countries has experienced relative neglect. This collection, however, examines the debates around competing ordering principles with evidence coming from operational problems of Westminster style democracies in four world regions, and considers how a multi-disciplinary perspective can guide comparative analysis.  相似文献

ABSTRACT

This article seeks to contribute to the literature centred on the principle of subsidiarity by highlighting the way in which political actors apply different dimensions of subsidiarity, horizontal versus vertical, in the field of labour market policy. It compares labour market reforms in Britain and Italy in the wake of international economic crises, shedding light on the role of subsidiarity dimensions. It shows that Britain applied the principle of horizontal subsidiarity in quasi-market mechanisms while Italy chiefly resorted to the vertical dimension that helped shifting labour market policies from income replacement to welfare-to-work. Additionally, the article explores how the principle of subsidiarity may affect the relationships between the European Union on one side and Britain and Italy on the other in the field of labour market policies.  相似文献

This article analyses two aspects of the reality of Chilean women during the United Nations Decade of Women: political participation and labour force participation. This analysis takes into account some of the proposals of the Regional Plan of Action for the Integration of Women into Latin American Economic and Social Development as well as the consequences of the political, cultural and economic model established by the Chilean military government. The effects of the Decade of Women on Chilean women is not analysed primarily because the specific proposals contained in the Plan of Action are based on the prerequisites of development and participation—which are not applicable to the Chilean case during this period.Notwithstanding the fact that all forms of popular participation have been effectively eliminated, there have emerged women's organizations whose concerns include calling into question the oppression of women on the basis of sex. With respect to labour, women's participation in the labour force has increased. However, this increase is not a response to improved opportunities or a more equalitarian treatment of women workers, but rather as the consequence of elevated unemployment rates especially in lower class families where women have greater access to certain kinds of marginal employment.On a final note, the article also includes a discussion of recent trends in research on women, trends which provide a challenge to the more traditional forms of research.  相似文献

Neonaticide is an infant murder occurring on the day of birth. The case reports found in the literature are often focused on the mother as the agent in the context of pregnancy denial, dissociative symptoms, or psychosis. However, this report describes a rare case of attempted serial neonaticides, in which the acts were committed by a nurse at the nursery of a referral hospital in Brazil. The authors describe a forensic psychiatric evaluation for criminal responsibility and correlate the information from this particular case with relevant forensic themes, namely neonaticide, Munchausen by proxy syndrome, and serial healthcare killers.  相似文献

Most studies on voluntary organisations and advocacy groups focus on their contribution to democracy through participation in the policy-making process. The uniqueness of this study consists in shifting the emphasis to participatory democracy at the implementation stage of the policy process. We argue that public donors may affect the democratic potential of voluntary organisations at this stage. To this purpose, we explore the European Union's structuring effects. Firstly, the European Union manufactures a non-governmental organisation (NGO) landscape through a top-down process of redistribution of resources. Secondly, our attention is drawn to NGOs' adaptations of EU requirements, which entails a transformation process often at odds with participatory practices. In order to grasp the European Union's differential impact, we include in our analysis two sectors (humanitarian NGOs and social voluntary organisations) and two Member States (France and Spain).  相似文献

Abstract: Detection of mass graves utilizing the hyperspectral information in airborne or satellite imagery is an untested application of remote sensing technology. We examined the in situ spectral reflectance of an experimental animal mass grave in a tropical moist forest environment and compared it to an identically constructed false grave which was refilled with soil, but contained no cattle carcasses over the course of a 16‐month period. The separability of the in situ reflectance spectra was examined with a combination of feature selection and five different nonparametric pattern classifiers. We also scaled up the analysis to examine the spectral signature of the same experimental mass grave from an air‐borne hyperspectral image collected 1 month following burial. Our results indicate that at both scales (in situ and airborne), the experimental grave had a spectral signature that was distinct and therefore detectable from the false grave. In addition, we observed that vegetation regeneration was severely inhibited over the mass grave containing cattle carcasses for up to a period of 16 months. This experimental study has demonstrated the real utility of airborne hyperspectral imagery for the detection of a relatively small mass grave (5 m2) within a specific climatic zone. Other climatic zones will require similar actualistic modeling studies, but it is clear that the applications of this technology provide the international community with both an early detection tool and a tool for ongoing monitoring.  相似文献
