What do Americans know about their local judges and how do they know it? One of the central arguments in the debate over judicial elections is whether voters know enough about judicial candidates to make an informed democratic choice. The vast majority of criminal and civil matters in the U.S. begin with and filter through the local state courts. But judicial scholars know little about what explains the variance in voters’ knowledge of their courts and judges. This paper draws on survey data from the 2012 Cooperative Congressional Election Study to investigate the origins of voter knowledge of local judges. A central finding of this study is that rural voters are a lot more knowledgeable about their local judges than are urban voters, ceteris paribus. This finding has significant consequences for the debate over the ways in which states structure their elections for local judges.  相似文献

Prosocial behaviors (i.e., actions that benefit others) are important markers of healthy social functioning, and understanding the factors that predict such outcomes among recent immigrant Latino adolescents is important. The current study examines the longitudinal associations between maternal involvement and prosocial behaviors via collectivism values. Data comes from a longitudinal project (Construyendo Oportunidades Para los Adolescentes Latinos) of 302 recently immigrated U.S. Latina/o adolescents (53.3% male, average age?=?14.51 years old). The current study uses data from three times points across 2 years. The results demonstrated that maternal involvement was positively associated with collectivism values. Collectivism was positively associated with changes in prosocial behaviors. There was also partial support for a reverse-causal model. Discussion focuses on the links among parenting, cultural values, and prosocial behaviors among immigrant U.S. Latina/o adolescents.  相似文献

This study investigates the major pockets of activity of Chinese criminal groups from 2000–2003, throughout the world except for Mainland China, Hong Kong, Macau, and Taiwan. The main geographical regions of such activity are Australia, Europe, Japan, Latin America, North America, Russia, South Africa, and Southeast Asia. The report notes the participation of such groups in all major types of crime, including trafficking of human beings and various commodities, financial crimes, extortion, gambling, prostitution, and violent crimes. For the purposes of this report, the term “Chinese” refers to individuals of purely Chinese ethnic origin living in any part of the world. The criminal groups described vary in size and degree of structure; they include syndicates, triads, gangs, and ad hoc combinations of organization members and non-members. Because of this variety, an increasing tendency toward ad hoc activity, and the lack of specificity in many open sources, the term “group” is used when a criminal activity is not attributed to a specific type of organization. The report's sources are several recent monographs, journal articles on various aspects of such crime in the geographical regions where it occurs, and Internet reports by journalists and law enforcement agencies. Some sources published prior to the time period covered by the report have been used to provide background and establish long-term trends.  相似文献

In this paper the author first presents a critical account of some basic views of Habermas' Discourse Philosophy. He points out some difficulties inherent in notions such as valid justification in argumentation theory, in the notion of ideal form of discourses, and in consensus theory of truth. Secondly, he focuses on Habermas' conceptions of validity, acceptance and legitimacy of law from the perspective of neo-institutionalism. In particular, (i) the author argues that Habermas' definition of legal validity is unclear and unrealistic; (ii) the author stresses the distinction between acceptance and acceptability; (iii) Habermas presupposes harmony between sovereignty and human rights postulates, but the present author takes into account the possibility of conflicts between autonomous popular decisions and human rights which must be resolved by methods of discursive democracy; (iv) criteria for acceptance of law cannot be fixed by a stipulative definition, but are in social discussion; (v) legitimacy is not an objective feature of valid law and presupposes an evaluation based on our political convictions.  相似文献

Self-inflicted contact gunshot wounds to the head have usually been considered presumptive of suicide. This study evaluates whether sufficient psychological data are gathered in such cases to support a manner of death determination of suicide. We suggest that law enforcement agencies and coroner's departments do not fully explore the decedent's state of mind at the time of death. We studied the first 50 consecutive deaths in 1993 in a major metropolitan county due to self-inflicted gunshot wounds to the head. The sample consists primarily of unmarried, white males, with a median age of 35 years, who displayed psychiatric disturbance, primarily depression, before their death. Younger individuals were often under the influence of alcohol and/or drugs at the time of death. Stressors, such as the loss of a loved one, are common among young and middle-aged persons, while serious health problems are found among the majority of middle-aged and elderly individuals. Many of the findings of this study are consistent with the literature regarding individuals who commit suicide. Although data on many important psychological risk factors are missing in most cases, sufficient psychological material is gathered about the decedent's mental condition at the time of death to support a suicide determination.  相似文献
