This article explores the dynamics of citizenship under conditions of statelessness and in territories with uncertain sovereignty. The Gaza Strip under Egyptian Administration (1948–1967) – a nearly indefinable entity that was under Egyptian authority but no one's sovereignty – offers an especially good site for this exploration. In this period, both the government and the population were invested in some notion of Palestinian citizenship, but there was no Palestinian state to codify that concept. The Palestinian loss of formal citizenship with the end of the British Mandate in 1948, and the continued absence of this legal category, has shaped Palestinian life and political identification in profound ways. Even under these conditions, though, both conceptions about, and the social practice of, citizenship have also been crucially important for Palestinian community. Conditions in Gaza under Egyptian Administration illuminate a ‘refracted citizenship’ that articulated a relationship to both a future state and an existing government. Considering both the earlier dynamics of citizenship and sovereignty under the contested circumstances of the Mandate and the details of Egyptian governing practices in Gaza, the article argues that refracted citizenship provided a mechanism for people to make claims of the existing government and offered a means for that government to better manage the place and people of Gaza. Refracted citizenship also enabled people to build new community relations within Gaza – to develop a sense of specifically Gazan community – without feeling that they were jeopardizing their claims to Palestinian citizenship.  相似文献

The Garrison Diversion Unit (GDU) was authorized by Congress in 1965. It is one of the largest and most expensive public works projects ever undertaken in the United States. When completed, it may become the last major federal irrigation scheme constructed in the west. Its principal purposes are: (1) to irrigate some 250,000 acres of arable land in North Dakota, (2) provide water for municipal and industrial use in fourteen communities, and (3) enhance recreational opportunities and fish and wildlife management programs within, and adjacent to, the canals and reservoirs resulting from its construction. The project is to be financed by hydropower sales from Lake Sakakawea, created when Garrison Dam was completed in 1956.1 Concerted litigation, Canadian opposition, and federal budget cuts have sharply reduced the size and scope of GDU since 1984. Its irrigable acreage has been reduced by over 50%, a principal feeder reservoir has been eliminated, and provision of municipal and industrial water delivery has been moved from second to first priority by a Congressional commission. The GDU controversy illustrates the consequences of the lack of a coherent environmental ethic guiding American natural resources policy. These consequences are two-fold. First, although GDU's impacts extend to Canada, there is little agreement between the U.S. and Canada over what values should guide transboundary water resources development. Second, American beneficaries of the project define its need in pre-emptory terms - i.e., as compensation to an entire region for losses of land associated with the original construction of Garrison Dam. Opponents, meanwhile, argue their case in meliorative terms - i.e., that the costs to society of building additional water projects are not outweighed by their benefits. A growing body of literature suggests that courts and juriesare inclined toward division of liability between two strictlynon-negligent or "vigilant" parties. In this paper, we explorethe economic efficiency of liability rules based on comparativevigilance. We devise rules that are efficient and that rewardvigilance. Commonly used liability rules have discontinuousliability shares. We develop a liability rule, which we callthe "super-symmetric rule," that is both efficient and continuous,that is based on comparative negligence when both parties arenegligent and on comparative vigilance when both parties arevigilant, and that is always responsive to increased care.  相似文献

Ten years ago we developed a model of demand inducement in the physician services market and explored the properties of that model. We found that predictions concerning physicians' prices, workloads, and income were ambiguous and in many cases were consistent with those derived from a standard monopoly pricing model. Spurred in part by our work, numerous empirical studies of the demand inducement model have been conducted. These studies found little evidence of demand inducement for primary care physician services. Demand inducement may exist in the market for surgical services, but its extent is less than previously estimated. We disagree with those who say that physicians generate demand to avoid price controls and that national health care spending is proportional to the number of physicians; the evidence does not support these arguments. Substantial uncertainty may surround the physician's choice of diagnosis and treatment mode. However, this does not imply a breakdown of the agency relationship. In this paper we extend our earlier model of demand inducement to include variations in the quantity of services (which was previously assumed to be less than socially ideal). Using the model, we conclude that the major objection to government price setting is not that physicians will get around the controls by inducing demand; rather, price controls result in a quantity and quality of physicians' services that is not ideal and may be inferior to those provided in an unregulated monopoly.  相似文献

This study examines the experience of emerging adult immigrants, a group simultaneously attempting to navigate the developmental period of exploration and experimentation of emerging adulthood, together with the need for re-organization of the self, following immigration. In this study, in-depth interviews were conducted, with 41 emerging adult immigrants from the former Soviet Union in Israel and 42 non-immigrant Israeli emerging adults (all in the age group 21–25), on the subjects of sense of self, family relations, and age-appropriate tasks of emerging adulthood. Results showed that while immigrant emerging adults had a more disorganized sense of self, they also showed higher levels of both autonomy and relatedness in the relationship with their parents. Immigrant emerging adults had fewer social networks, yet more intimate relationships. Emerging adult immigrants' story was one of “relatedness” where level of self-organization was related to closeness, caring, and identification with parents, and closeness in both social and intimate relationships. In contrast, the non-immigrant emerging adults told about a process of “autonomy seeking” where a consolidated sense of self was related to more independent decision-making, emotional independence, and assertiveness in the relationship with parents. The findings of this study point to the complex and unique process that emerging adult immigrants undergo while coping with developmental tasks in their new environment. The authors engage structural and agentic perspectives to examine opportunities for deliberation and the purposeful role of managers in creating those opportunities. Drawing on actor-network theory as a way of understanding the process of structuring knowledge, this essay focuses on the continuous enactment and reenactment of networks of human and nonhuman actants and the associations that connect them. This thinking is applied to policy issues, which the authors propose should be understood as ways of knowing. The fluidity of such ways of knowing provides opportunities for public managers to use the inclusive practices associated with boundary experiences, boundary objects, and boundary organizations to facilitate deliberation.  相似文献
