An increasing number of development scholars and policymakers are recognizing the importance of Latin American judicial reforms in shaping the ultimate outcome of the region's "dual transition." We can hardly begin to assess the conditions in which judicial systems are likely to improve, however, unless we have a means to measure judicial performance systematically across countries. This article offers just such a comprehensive cross-national measure of judicial performance for Latin America. Drawing from a survey of Latin American legal scholars and practitioners from 17 countries in the region, it seeks to establish a more valid, and therefore more useful, assessment of the performance of Latin American judiciaries than existing measures, in order to advance efforts to understand the causes and consequences of effective judicial reforms in the region.  相似文献

This paper sets out to show whether constituency campaign effects exist, particularly in the context of a preferential electoral system such as Australia's. Data from the 1993 Australian Election Study suggest that, despite the best efforts of the candidates, local campaigning has a very limited impact on the vote. The paper considers a range of possible explanations for this limited impact: displacement, MPs' perceptions of their role, sources of campaign information, the importance of party labels in Australia, party discipline. It concludes with an explanation for the apparent paradox of why candidates bother campaigning when it does not make a difference to their vote.  相似文献

A distinctive approach to disciplining the Soviet population emerged following the Terror of 1937–1938, and as a consequence of World War II, around the notion of socio-political and socio-economic ‘organisation’. The early post-war years as a consequence saw the introduction of innovative means of social disciplining in all areas of Soviet society. The infamous attack on the post-war intelligentsia, in particular, resulted from Stalin’s belief that only through the intelligentsia’s correct ‘leadership’ of this socio-economic ‘organisation’ would the Soviet Union be able to meet its challenges of reconstruction and superpower consolidation. This post-Terror and post-war phase in Stalinism marked a lasting turn, which consolidated the authoritarian socio-political dynamics evident in the later post-Stalin Soviet system.  相似文献

Although considerable resources and attention have been allocated to recent ‘good governance’ public management reform in low income and fragile states, there is little evidence as to what degree this agenda has been implemented nor as to whether it has led to improved services and outcomes for populations. To address this lacuna, we conduct a review of the large but almost entirely qualitative literature on good governance reform in the 49 countries classed as low income by the United Nations. We find only a small number of documents that link good governance public sector reform agendas with implementation. Fewer still assess outcome. We conduct an empirical analysis of the relationship between reform agenda (using data from the literature review), implementation, service delivery and outcomes, as measured by performance on Millennium Development Goals indicators. The majority of information systems developments are unsuccessful. The larger the development, the more likely it will be unsuccessful. Despite the persistence of this problem for decades and the expenditure of vast sums of money, computer failure has received surprisingly little attention in the public administration literature. This article outlines the problems of enthusiasm and the problems of control, as well as the overwhelming complexity, that make the failure of large developments almost inevitable. Rather than the positive view found in much of the public administration literature, the author suggests a pessimism when it comes to information systems development. Aims for information technology should be modest ones, and in many cases, the risks, uncertainties, and probability of failure mean that new investments in technology are not justified. The author argues for a public official as a recalcitrant, suspicious, and skeptical adopter of IT.  相似文献

This essay provides a gloss on the relationship between the common law and the ‘law of the land’. It does so by turning attention to the technologies and identifications that continue to give Australian jurisdiction its place. These relations repeat the long pattern of the common law ordering of colonisation. They also provide the governmental conditions of legal responsibility for settlement. This paper examines mobilization and conversion perspectives of opinion change during election campaigns. We demonstrate that opinion volatility during ballot proposition contests often reflects mobilization of awareness more than conversion of opinions. Furthermore, we find little support for the hypothesis that media spending affects opinions on the propositions examined here. An examination of other information sources suggests that many voters are able to use cues other than advertising when making decisions.An earlier version of this paper was presented at the Western Political Science Association meeting, Pasadena, California, March 22, 1993.
