Republicanism and human rights: a plausible combination?

I consider a small but growing corner of the global justice literature: conceptions of human rights advanced under republican lights. I outline three recent republican justificatory arguments for principles of global justice embodied in human rights: Stuart White's appeal to the republican emphasis on civic virtue, and the appeals to a republican conception of liberty advanced by Philip Pettit and James Bohman. I argue that in all three accounts, too little attention is paid to constraints on the reasons that can be offered to a diverse domain of agents. I sketch an outline of the criteria plausible justificatory reasons must contain. In the appeal to virtue, no such reasons are forthcoming. In the appeal to liberty, such reasons may be forthcoming if republicans give up the claim that human rights are justified by appeal to ‘liberty’ itself. I conclude that a suitably modified appeal to the republican conception of liberty may be plausible.

In this research, Professor Jürgen Simon and Christian Ravenstein have highlighted the general existing prohibition, in the labour field, of the undertaking of genetic tests that could mean discrimination for the genetic heritage of the worker. They have made a comparative study of several member States of the EU that have specific regulation on this area.     

The political effects of referendums: An analysis of institutional innovations in Eastern and Central Europe

Theory suggests that the political effects of referendums should vary according to the institutional provisions that allow for direct involvement of citizens in decision-making. Relying on extant theoretical models the paper proposes initial tests of some implications for the newly democratized countries in Eastern and Central Europe. The constitutions of these countries distinguish themselves by a wide variety of institutional provisions for referendums. Taking advantage of this increased variance, the paper demonstrates effects of different institutional provisions on policy outcomes, which, so far, have only been demonstrated at the sub-national level, for example, in the United States and Switzerland.     

A Formula for Disaster: The Department of Homeland Security's Virtual Ontology

This paper focuses on the Department of Homeland Security (DHS) in order to theorise the spatialities of post-9/11 security knowledge and practice in the US. It analyses the organisational discourses that animate homeland security work, such as preparedness, vulnerability, the new threat environment, risk analysis and capabilities-based planning, and considers the implications of these practices for contemporary geographies of security. It is argued that DHS operates through a virtual ontology of threat, whereby potential, future threats are addressed as present possibilities that emerge in the spaces of everyday life. The sources of American freedoms and insecurities, the everyday, emerging circulations of goods and people, present DHS with a terrain of shifting threats from which both emergencies and preparedness may materialise. Disaster looming, the potential suspension of everyday life forms the basis for security practice as the emergency becomes a fact of life itself. The spatialities of this environment of imminent threat are considered and it is argued that the everyday emergency operates topologically as a continuous process of spatialisation.     

Review Article: International Distributive Justice

The literature on global justice contains a number of distinct approaches. This article identifies and reviews recent work in four commonly found in the literature. First there is an examination of the cosmopolitan contention that distributive principles apply globally. This is followed by three responses to the cosmopolitanism, – the nationalist emphasis on special duties to co-nationals, the society of states claim that principles of global distributive justice violate the independence of states and the realist claim that global justice is utopian and that states should advance national interest.
