Contending conceptions of the "new" institutionalism claim to offer approaches that can develop generalizable social scientific theories of behavior. This article challenges that proposition, arguing that contingencies exist in which specific forms of institutionalism are best suited to addressing particular types of questions. Viewed through the prism of public policy, it develops the argument that 'policy dictates politics.' I consider a small but growing corner of the global justice literature: conceptions of human rights advanced under republican lights. I outline three recent republican justificatory arguments for principles of global justice embodied in human rights: Stuart White's appeal to the republican emphasis on civic virtue, and the appeals to a republican conception of liberty advanced by Philip Pettit and James Bohman. I argue that in all three accounts, too little attention is paid to constraints on the reasons that can be offered to a diverse domain of agents. I sketch an outline of the criteria plausible justificatory reasons must contain. In the appeal to virtue, no such reasons are forthcoming. In the appeal to liberty, such reasons may be forthcoming if republicans give up the claim that human rights are justified by appeal to ‘liberty’ itself. Theory suggests that the political effects of referendums should vary according to the institutional provisions that allow for direct involvement of citizens in decision-making. Relying on extant theoretical models the paper proposes initial tests of some implications for the newly democratized countries in Eastern and Central Europe. The constitutions of these countries distinguish themselves by a wide variety of institutional provisions for referendums. This paper focuses on the Department of Homeland Security (DHS) in order to theorise the spatialities of post-9/11 security knowledge and practice in the US. It analyses the organisational discourses that animate homeland security work, such as preparedness, vulnerability, the new threat environment, risk analysis and capabilities-based planning, and considers the implications of these practices for contemporary geographies of security. It is argued that DHS operates through a virtual ontology of threat, whereby potential, future threats are addressed as present possibilities that emerge in the spaces of everyday life. The sources of American freedoms and insecurities, the everyday, emerging circulations of goods and people, present DHS with a terrain of shifting threats from which both emergencies and preparedness may materialise. Disaster looming, the potential suspension of everyday life forms the basis for security practice as the emergency becomes a fact of life itself.
