This article addresses claims regarding the limited legitimacy of international institutions. It argues that the two original appointed supranational institutions of the European Union play a crucial, if systematically underestimated, role not merely in providing legitimacy for the Union itself, but also in shoring up that of its constituent member states. We illustrate that supranationalism enhances national legitimacy in functional, political and administrative terms. It does so by helping member states produce outputs they otherwise could not (particularly by enabling them to deal with transboundary policy problems they would struggle to confront if acting in isolation) and by embedding within national political and administrative systems legally enforceable obligations to respect the interests of actors whose voice is excluded or muffled (de jure or de facto) within purely national political processes. The article contends that the claims to legitimacy made by the EU and its member states are of distinctive character but interdependent and mutually reinforcing.  相似文献

ABSTRACT

Scholars are increasingly exploring the links between the other worlds of science fiction and theorizations of our own reality. This article extends the scope of political science fiction studies by focusing on the Chinese author Liu Cixin's Three-Body novels, thus incorporating a key non-Western work. I interrogate the Three-Body series through the lens of Kenneth N. Waltz's three images of international relations, recovering the abundant homologies across the texts. Both writers represent human nature as malevolent, are skeptical of the importance of domestic politics, and place most weight on the logic of survival perpetuated by an international/interstellar system. They share meta-theoretical commitments too, each stating that global/galactic politics must be interpreted rather than observed. Yet the final pages of Liu's text destabilize the apparently copacetic relationship with Waltzian thought. Liu reveals his interstellar system to be created rather than given, and subject to positive transformation through the acts of agents. Liu's final move calls into question statist, positivist, and zero-sum premises about our contemporary world order by suggesting that they, too, are created by powerful actors rather than being scientific givens. The EU's agenda in promoting multilateralism faces a few challenges in the eastward direction. The Caspian Sea basin, which has been acquiring increasing importance for the EU in the context of energy, above all gas, supplies from the Caucasus and Central Asia, represents a complex mix of states with different histories, identities, regimes, centres of gravity and regional ambitions. Unlike the Black Sea basin, where the EU has developed the Black Sea Synergy policy, none of the Caspian littoral states is an EU member and this has led to a lack of EU interest in and commitment to the promotion of multilateralism in the area. Thus, in spite of significant energy security interests, the EU lacks the will, the capacity or the consistency to address regional security issues or promote reform. Indeed, economic interests are inevitably likely to clash with the reform promotion objective.  相似文献

The emerging global order is challenging multilateralism in the sense that power is becoming situational: centres of gravity are overlapping and transient, and the transnational interdependence that characterises this ‘polypolar’ world challenges small and great powers alike. Emerging powers are forming a ‘new middle', straddling the North-South divide with dynamic new multilateral formations, and prioritising economic self-interest. South Africa is at risk of being relegated to a new global periphery if it gives priority to political solidarity with the global South rather than economic pragmatism in its multilateral strategies. Its comparative advantage in the diplomatic arena is its middle power credentials. If it rationalizes its multilateralism to focus on diplomatic niche areas it can enhance its political influence in global governance institutions, despite its small economic stature.  相似文献

The article presents a framework for better understanding the nature of performance in organisations involved in the provision of overseas development assistance (ODA). It uses a case study to illustrate the three main features of the framework which are: goals, performance assessment and performance management. It is asserted that a vibrant performance culture is one which links these features together to form an organisation capable of continual improvement through producing effective learning. Organisational culture determines the nature of linkages between the three sub‐systems. The article stresses how the notion of performance may extend beyond various forms of evaluation and scrutiny to being part of a sentient learning system rooted in an organisation's culture and structure. The article concludes with consideration of key issues associated with the generation of a reflexive learning organisation operating in the ODA sector. These are concerned with understanding the role and nature of systems, organisational vision, the embracing of diversity, training and accountability. This review of country‐level performance assessment in donor agencies is primarily based upon the experiences documented by bilateral donors to developing countries. The review suggests that four emerging themes can be identified in the literature on country‐level performance review: ownership, decentralisation and leadership, accountability and learning and complexity. The review considers the implementation of ‘results‐based’ approaches used by a number of international agencies and examines their relationship with ‘evidence‐based’ approaches. A key challenge, in the development of performance assessment, is bringing in a stronger evidence‐based approach into the planning and evaluation of donor country‐level programmes. Abstract: The probation service is at risk of serious harm from the discourses of toughness and cure. People subject to community rehabilitation orders are categorised first and foremost as ‘offenders’ by probation officers, their managers and governors. Not surprisingly, people on probation are increasingly viewed as bad or as misfits, either way they have nothing intrinsically valuable to contribute to their supervision nor to the work of the probation service more generally. As a counter to this exclusion and disenfranchisement, two replacement discourses are commended: first, the language of userism/consumerism; and, second, an integration of strain and rational choice crime theories, as an alternative to the ‘psychic prisons’ of conservatism and individual positivism fast enveloping the service.  相似文献

This article reports the results of two studies. The first study, based on the responses of attorneys to questions about the reasons for the success of mediators with and without prior judicial experience, shows that the capacity of the mediator to gain the confidence of the disputants was most important for mediators with and without prior judicial experience. Although certain process skills were viewed as important to the success of both former judges and nonjudges, in general, process skills were significantly more important for nonjudges than for former judges. The capacity to provide useful case evaluations, on the other hand, was significantly more important for former judges than for nonjudges. The second study, based upon attorney responses to questions about unsatisfactory mediators, reinforced the conclusions of the first study regarding the importance of confidence-building attributes. For both judges and nonjudges, the mediator's inability to gain the confidence of the parties was a major reason for his or her lack of success.  相似文献
