The present research investigated decision-making processes in joined trials of multiple offenses. Subjects judged videotaped trials of three joined charges in a factorial design that varied charge similarity, evidence similarity, and judges' instructions designed to reduce judgement biases; or judged one of several charges presented individually. The results indicated that subjects were more likely to convict a defendant in a joined trial than on the same charge tried by itself, particularly when the charge was presented in the third position. Convictions were more frequent when joined charges were similar, and judges' instructions significantly reduced conviction rates. Subjects judging joined trials confused evidence among charges, rated the prosecution's evidence as stronger, and rated the defendent less favorably than subjects judging single trials. The findings were compared statistically to the results of previous research, and it was concluded that increased convictions in joined trials are robust effects.This research is based on part of a doctoral dissertation by S. In this essay, I illustrate a way of following discussions of economic globalization into discussions of domestic national issues involving cultural critique, arguing that the character and interests of local sites for transnational exchange are key aspects of analysis and closely associated with the logic of globalization theories. The essay begins with a summary of Saskia Sassen's place-based view of globalization, while in the second section, I consider five aspects of this place-based view in light of Chinese contexts for the international exchange of cultural critique. In the final section, I offer a broader sketch of three commonly discussed views of globalized, transnational forces and their relationships to domestic issues of cultural critique.  相似文献

This study emphasizes the need to include purchasing, or procurement, as a topic in the graduate-level public administration curriculum. It notes the absence of purchasing research in mainstream public administration journals and in leading public financial management textbooks. The study also reports the results of a survey mailed to the purchasing directors of the 46 largest U.S. counties outside Florida. The survey was designed to familiarize academians and practitioners with various administrative, legal, structural, and procedural dimensions of county procurement policies. Areas of greatest deficiency are those dealing with protest and appeals procedures and contract monitoring, and to a lesser extent procedures for declaring an emergency, entering into intergovernmental purchasing agreements, and contracting with minority businesses. The most comprehensively-covered elements are those delineating award authority, small purchase authority, methods of soliciting bids, definitions of emergencies and professional services, and procedures for contracting professional services.  相似文献

The Coase theorem tells us that monetary damages and specific performance remedies for breach of contract have identical effects when transaction costs are zero. This has become a standard part of the literature on the economics of contract law. This note argues that the traditional view is somewhat misguided, as monetary damages and specific performance remedies are unnecessary in a zero transaction costs world. We go on to show how the presence of transaction costs impact the decisions of contracting parties as between the inclusion of liquidated damages clauses in contracts and resorting to litigation that could result in the application of either monetary damages or specific performance remedies.  相似文献

In the wake of Mexico's electoral watershed of 2 July 2000, many scholars are willing to classify the country as an electoral democracy, yet debate persists over whether Mexican democracy is consolidated. This article seeks to advance this debate by clarifying the meaning of the term democratic ‘consolidation’ and how it should be operationalised. It argues that the concept should refer exclusively to a regime with a low probability of democratic breakdown. This avoids the conceptual confusion created by viewing consolidation as any change that improves the quality of democracy. In terms of measuring consolidation, it maintains the importance of placing greater weight on the proximate cause of regime instability, anti‐democratic behaviour, and discounting more remote causes of democratic breakdown, including economic performance, institution building, and attitudinal support. Based on this understanding, the article explains why Mexican democracy is fully consolidated.  相似文献
