试论自白排除规则在我国刑事诉讼中的构建

本文论述了自白排除规则的含义及法律价值 ,分析了自白排除规则在英、美等西方国家的确立、运用及对我国的启示 ,检讨了我国现行刑事诉讼法中确立自白排除规则所存在的障碍 ,在些基础上 ,主张构建符合中国政治、经济和法文化特色的坚持被疑人任意性与合法性程序相统一、自由与安全并重的自白排除规则 ,并对其相关配套制度进行了探索 ,旨在实现惩罚犯罪和保障人权的最大和谐。     

The politics of U.S. most-favored-nation treatment to China: The cases of 1979 and 1990

This article seeks to analyze U.S. interests in granting China the most-favored-nation status in 1979 and the present situation regarding the extension of such status. It argues that while the change and continuity in U.S.-China policy interests and objectives may still guide U.S. decision makers, what happened in Beijing last spring has given rise to a formidable congressional coalition among liberals, conservatives, and protectionists in opposing MFN treatment to China. The final outcome will depend largely on the degree of presidential readiness to defend his China policy and on whether the president is able to prevent the congressional overriding of the presidential veto.     

危机警务的概念化

危机警务的对象是公共危机 ,是公众危险和公众失序 ,包括恐怖性事件、群体性事件、公共性事故等具有公共影响的重大事件。危机警务包括危机警务哲学、危机警务勤务和危机警务技术三个层次的涵义 ,具有公众危险警务和公众失序警务两项业务 ,涵盖事先、预备、事发、事后警务四个阶段。相对于常规警务 ,危机警务的对象具有一定特征 ,其实施具有一定特点。

Democratization and bureaucratic restructuring in Taiwan

Taiwan has been moving toward democracy, with a dramatic transition taking place in the past decade. Critical to this transition is a restructuring of the relationship between the state bureaucracy and society. This study focuses on democratization's effect on Taiwan's bureaucracy. In particular, it seeks to examine such aspects of bureaucratic transformation as bureaucratic decisionmaking, legislative-bureaucratic politics, interest group-bureaucratic relations, the expansion of local autonomy, and civil service reform. This study finds that the bureaucratic state is facing a great challenge from political, legislative, and societal forces. The old type of insulated bureaucratic planning and decision making is no longer possible, the bureaucracy is losing its KMT patrons, and bureaucrats are finding themselves answerable to political pressure, legislative oversight, and interest group lobbying. While the bureaucracy has lost its previous level of discretion in terms of macro-management and the formulation of developmental policies, the bureaucratic state has not withered away. Qingshan Tan is Associate Professor of Chinese and East Asian politics and Director of the International Relations Program in the Department of Political Science at Cleveland State University. 中国志愿服务发展的"珠江特色"

当代中国志愿服务的发展形成"北方范式"与"南方范式".北方以北京市志愿服务的统筹推动为主要特色,南方以广东省志愿服务的灵活探索为主要特色.为此,需要对南方领域最先诞生志愿服务、最早探索公益创新的"珠江特色"进行分析.研究发现"珠江特色"具有独特的体系,即敢为人先的价值体系,一体多元的组织体系,灵活创新的项目体系,社会聚合的保障体系等等.同时,"珠江特色"的双构建值得重视:"双源泉"是中华源泉与海外源泉、"双模式"是志愿服务与义务工作、"双力量"是政府力量与民间力量、"双专业"是社会工作与志愿服务、"双资源"是财政支持与社会资助、"双功能"是主流推广与小众维护等等.这样,"珠江模式"成为中国特色志愿服务的重要组成部分,引起国际国内的关注和重视.     

Socially desirable responding and psychometric assessment of dynamic risk in sexual offenders against children

Does socially desirable responding (SDR) represent a threat to the validity of dynamic risk assessment in sex offenders’ self-reports? We studied a sample of men (N?=?218) who completed a psychometric assessment battery while enrolled at Kia Marama, a prison-based treatment program for sexual offenders against children. SDR, as measured by the Marlowe-Crowne scale, was elevated compared to non-offender samples, increased from pre- to post-treatment, and was negatively correlated with dynamic risk (rs?=??.30 to ?.40), consistent with previous research. Measures of dynamic risk factors derived from the psychometric battery were correlated with sexual recidivism, but correlations were little changed when variance associated with SDR was removed using a regression procedure [Mills, J. F., &; Kroner, D. G. (2006). Impression management and self-report among violent offenders. Journal of Interpersonal Violence, 21(2), 178–192.]. These results suggest that there is a substantial component of the variance in psychometric self-reports of sexual offenders that is associated with SDR (approximately 10%), but that it does not compromise the predictive or construct validity of dynamic risk measures derived from these reports.     

虚假诉讼法律监督联动协作机制研究

由于工作机制不健全,目前虚假诉讼监督工作存在不少薄弱环节。为了更好地监督和惩治虚假诉讼,检察机关宜多管齐下、内外兼修,建立健全虚假诉讼监督联动协作机制。在政法领域,检察机关应当积极争取党委支持,强化与其他司法机关的沟通联系,统一认识、紧密配合,形成打击合力,以会签文件的方式建立联动协作工作机制。在检察系统内部,应当完善相关工作机制,实行上下级一体化办案、各部门横向协作、检察长靠前指挥,加大虚假诉讼监督工作力度。
