This article assesses whether the new European Community (EC) Regulation applying the provisions of the Aarhus Convention to EC institutions and bodies provides non-governmental organizations (NGOs) with access to justice in compliance with the EC's obligations under the Aarhus Convention. We conclude that, notwithstanding the uncertainty over the wording finally adopted in the Aarhus Regulation, the procedural rights granted to NGOs in the Regulation brings NGOs within the standing requirements of the EC Treaty, such that they can seek justice in the European courts. This is a significant development in the field of environmental democracy and procedural rights to the environment – including the ability to seek enforcement of the right to a healthy environment.  相似文献

This article argues that there is not one conception of the French nation and Republic among French Republicans, but two. One theory is assimilationist and centralising. It regards the Republic as one and indivisible and the French nation a cultural whole. The other is more regionalist, envisaging a republic that is perhaps indivisible, but certainly diverse and respectful of local cultures. The article traces these contending conceptions through three constitutional debates: the debate on the reform of the Empire in 1946; the debate on the adoption of the Maastricht Treaty in 1992; and the recent debate on decentralisation, which was re-launched at the beginning of the 2000s by the left and subsequently taken over by the right.  相似文献

Previous studies documented that crime is heavily concentrated in families. However, many studies relied on relatively small samples, often males and information on criminal involvement was self-reported. The present study investigates: (1) the prevalence of arrests in three generations; (2) the concentration of offenders and arrests within families; (3) the relationships between arrests among the relatives; (4) the relationship between arrests and family violence. A complete cohort of the families in which a child was born in a Dutch city was selected, and the arrests of all known family members (siblings, parents and grandparents) were investigated. Results showed that 7.2 % of the mothers and 18 % of the fathers had been arrested. The likelihood of parental arrests was related to the likelihood of grandparental arrests. There was clear evidence for assortative mating: when the mother was arrested, the likelihood that the father was arrested was increased with a factor five. Maternal arrests were also related to arrests of her parents-in-law. Arrests are heavily concentrated within families, 7.8 % of the families account for 52.3 % of the suspects. Arrests in family members constitute a major risk factor for poor developmental outcomes, such as criminal behavior. At the time of birth, it is possible to use information on arrests to select children who are at relatively high risk for the target of prevention efforts.Implications for prevention policies are discussed.  相似文献

Roll call voting by members of the US Congress has been frequently studied. In contrast, the various decisions leading up to roll call voting are relatively unexplored. This article analyses one of those decisions: when senators announce their final passage vote intention. The authors use the same set of variables to analyse both the timing of the announcement and the final passage vote. They find that different independent variables predict these two different decisions, though the constituency and the senator's institutional setting matter in both. Furthermore, this study corroborates an assumption in the rational choice literature that those members with the most information are the first movers.  相似文献

The public's approval of Congress is at an all time low. The parties seem to have taken the legislative process hostage for their own electoral gain. Whereas traditional arguments about congressional dysfunction focus on polarized voting coalitions or outputs – particularly legislation – in this article we highlight congressional information processing and how it has changed in this highly partisan era. By coding congressional hearings according to the kind of information on which they focus, we find that members of Congress are receiving one‐sided information to a greater degree and are spending less time learning about potential solutions. We use these results to make numerous recommendations for improving how Congress gathers its information.  相似文献
