事实与价值的调和——制度法学的方法论

麦考密克和魏因贝格尔于上个世纪在奥地利和英国分别提出了"制度法学"的理念,这在学术史上确实传为佳话.实证主义法学面对新自然法学的强烈攻击,从哈特的柔性实证主义法学分裂为拉兹为代表的排他性实证主义和以科尔曼为代表的包容性实证主义.而制度法学兼采实证主义法学、新自然法学、法社会学诸家之长,另立阵营.而他们的方法论较为独特,正适合社会发展中的法律的发展.所以,在法治成型的今天,对于制度法学的方法论可以给予我们不同的启示.     

美国因素和1962年《日内瓦协议》以后老挝内战的重启

日内瓦协议签署以后，美国并没有停止对老挝事务的干涉。美国政府在继续援助老挝反共力量的同时，进一步采取了促进老挝中立派与右派势力合作的战略。美国对日内瓦协议的公然违背造成了老挝政治力量的再次分化与重组。老挝再次陷人内战的同时，美国也对老挝事务进行了直接的军事干涉，使老挝最终成为越南战争的真正战场。     

Core self-evaluations in the military context： Relative effects on job satisfaction and organizational commitment

This study validates the construct of core self-evaluations （CSE） and examines the relationship of CSE with global job satisfaction and organizational commitment in the military context. Analytical results from 114 sergeants in the military school are summarized as follows： （1） Analytical results validate the convergent and discriminant validity of the constructs; （2） CSE has significant positive relationships with global job satisfaction and organizational commitment. This study provides practical implications for management in both business and military organizations and suggestions for future studies.

湖南省在建设生态和谐社会中创造性地提出了一个生态法律概念——湘江长株潭段生态经济带，并制定了一系列的法律措施。但是，这些法律措施实施五年来却进展很小。或许，管理者已将重点转移到长株潭城市群区域建设上来。建议管理者继续坚持湘江生态经济带建设，并将范围扩大到整个湘江流域。     

从刑法的价值与刑事政策角度看缓刑制度的完善

缓刑制度是集刑罚社会化、个别化、人道化于一体的刑罚制度,符合刑罚价值取向和人类文明进步的潮流,同时也符合我国宽严相济的刑事政策精神,在我国刑罚执行体系中占据重要地位。鉴于刑法的稳定性和社会生活的发展及刑罚价值取向的转变,我国缓刑制度亟待完善。     

Family Income Tests of Child Welfare in Canada and Australia and the Research Enlightenment

There is an increasing trend in western countries that income security is used as a tool to provide child welfare for low income families. As in Canada and Australia, where universal child welfare is turning to be more selective, family income tests set up the major thresholds for deciding the levels and the amount of child welfare that each family can enjoy. The experiences from both countries shed light on China’s development of a moderate general child welfare system, enhancing precise targeting for effective welfare distribution.
