Beyond Punishment: The Penal State's Interventionist,Covert, and Negligent Modalities of Control

This article investigates the involvement of the penal state in the lives of criminalized people as a controlling force that takes multiple forms. We offer the concept of modalities of penal control and identify three such modalities in addition to expressive punishment: interventionist penal control is accomplished in extralegal ways; covert penal control is hidden from public view; and negligent penal control is characterized by the absence of action by state actors. This article illustrates empirical cases of each modality, using data from three distinct projects based in Chicago, southern Wisconsin, and nationwide. The data include observations of post‐prison groups and homes, interviews with criminalized people and nongovernmental organizational (NGO) staff, statutes, and regulations. This expanded understanding of penal state involvement extends beyond the understanding that characterizes discussions of mass incarceration and highlights the need for comprehensive reform.

Föderalismus, Dezentralisierung und Performanz. Eine makroquantitative Analyse der Leistungsfähigkeit territorialer Politikorganisation in entwickelten Demokratien

Does federalism matter? We develop a theoretical model on the causal relationships between federalism, decentralization and system performance by merging the two literatures on political and fiscal federalism. The model is then tested in a quantitative analysis, including the OECD countries. We find that, consistent with our model, federalism and decentralization are different dimensions of the territorial organization of politics. Decentralization has positive effects; federalism tends to result in either no or a negative performance effect.

Taking Others into Account: Self‐Interest and Fairness in Majority Decision Making

Research on the formal properties of democratic aggregation mechanisms has a long tradition in political science. Recent theoretical developments, however, show that in the discussion of normative contents of democratic decisions, the actual shape of preferences deserves just as much attention. However, our knowledge about the concrete motivations of individual behavior in democratic decisions is incomplete. Using laboratory experiments, this article examines the existence of social preferences in majority decisions. Contrary to earlier experiments of committee decision making, we develop a design that controls for the conditions of communication and the level of information between subjects. This allows us to comparatively test the predictive power of several theories. We find strong evidence that self‐interest and fairness motivate human behavior in majority decisions.
