营商环境下我国民营企业保护与规制的博弈

营商环境下,支持民营企业的改革与发展,确保民营企业家的人身和财产安全,有助于民营经济更好更快发展。在保障民营企业合法权益之时,应当注意民营企业经营过程中的违法违规行为,加强对其规范化经营的引导与监管。兼顾民营企业的保护与规制,就是要防止法律规制民营企业的前置化,坚持刑法适用的谦抑性,审慎适用刑法手段,注重刑法最后手段的非犯罪化、非刑罚化、轻刑化,同时改变法律关于民营企业监管的滞后性局面,推行企业失信惩戒机制,创新消费者维权机制,建立积极作为的市场监管机制。     

Prisons or Problem-Solving: Does the Public Support Specialty Courts?

ABSTRACT

Recently, “problem-solving” courts have been developed as an alternative to imprisonment. They are often called “specialty” courts because they process and divert into treatment programs offenders who are seen as different from the general criminal population, such as those with mental health or drug problems, those who are homeless or veterans, and those who engage in domestic violence. Based on a 2017 national survey of 1,000 respondents, the current study examines overall public support for rehabilitation as a goal of corrections and then focuses specifically on support for different types of specialty courts. The analysis reveals that the American public endorses not only the rehabilitative ideal but also the use of problem-solving courts. Further, with only minimal variation, strong support for these courts appears to exist regardless of political orientation and sociodemographic characteristics.     

Inclusivity in Online Platforms: Recruitment Strategies for Improving Participation of Diverse Sociodemographic Groups

Governments are increasingly implementing smart and digital approaches to promoting citizen participation. However, whether online participation platforms are tools that improve inclusivity in citizen participation remains underexplored. To address this gap, this article focuses on the role of recruitment messages and their effect on participation in an online participation platform by gender and age. A field experiment with a neighborhood census sample (N = 6,066) shows that online participation dips for younger and older citizens and is equal among women and men. For the age groups between 60 and 75, differences in the control and intervention recruitment messages significantly impacted participation. These findings can help public managers tailor recruitment strategies to facilitate inclusive participation and represent a first step toward learning what types of messages are effective for whom.     

Fluorescence of a Natural Fluorophore as a Key to Improve Fingerprint Contrast Image

The optical and morphological properties of resveratrol were investigated. This nontoxic fluorescent natural material, emitting in the visible blue light, was used as an optical marker, enabling the enhancement of the image contrast coming from relief pictures marked on challenging surfaces. By applying appropriated imaging softwares, this marker was verified to be very useful in the latent fingerprint recognition deposited on different wood surface types, mainly those with high level of roughness, where conventional forensic materials do not allow effective fingerprint image visualization.

文学、艺术的创作应与社会史密切相关.书写城镇故事的叙事称之为"小城叙事".在传统的"小城叙事"中,通过语言讲述乡土伦理的"演叙"占据主流.20世纪80年代以后,在"小城叙事"中,"演叙"与工业化冲击下所产生的作品中的"消息"杂糅,而且随着城镇化日益锲入工业化,小城叙事的"消息"性质日益凸显.20世纪90年代末与新世纪之交,当代中国城镇的消费化、媒介化与虚拟化日益严重,仪式性的"演叙"传统变得面目全非,呈现魔幻化的叙事凸显.贾樟柯的系列作品是对当代中国城镇变化历程的清晰展示,在他的《三峡好人》中开始出现了人们直面城镇废墟化的存在主义勇气.     

受欺凌青少年的“沉默真相”及其行动逻辑——基于代际情感互动的视角

受欺凌青少年向父母保持"沉默",隐瞒被欺凌经历的现象十分普遍。本文从代际情感互动视角出发,通过网络民族志和深度访谈发现,当子代向亲代部分或全部披露欺凌事件,亲代继续实践日常情感互动模式会产生"虚假情感理解"甚至对子代进行身体惩罚,此外长时间的不良代际情感互动会导致受欺凌子代产生负面预期,为避免痛苦"再生产",理性的个体以向亲代保持"沉默"来进行自我保护。代际情感共同体建构是受欺凌子代实现共有感受期望的前提,代际情感互动的时空界限是真实理解受欺凌子代情感需求的基础,消解或转移受欺凌子代负性情感是打破沉默的关键,进而有助于家长理性参与校园欺凌干预,防范校园欺凌风险。     

法治视阈下基层社会矛盾的多元善治

全面深化改革进入深水区遭遇社会转型期,历史积累的问题与改革发展的问题交织,复杂多样的社会矛盾不断涌现,尤在基层社会凸显。从根源上看,基层社会矛盾仍属人民内部矛盾,多为民众的利益诉求而非政治诉求。重构基层社会矛盾治理路径,规制各方行为,维护好群众合理合法权益,是为基层社会矛盾治理之首要任务。新形势下,应以法治思维为指引,以社会主义核心价值观为依归,培育社会组织,强化社会组织和基层部门行为以及完善基层社会自治的法治规制,从而构建多元解纷的法治机制,达成涵摄“多元、共享、参与、合作、宽容”等包容性治理元素的基层社会矛盾多元善治,从而化解社会风险,维护公正、安宁、和谐的社会秩序。     

Applying Moral Foundations Theory to the Explanation of Capital Jurors’ Sentencing Decisions

Abstract

This study applies moral foundations theory to capital juror decision making. We hypothesized that binding moral foundations would predict death qualification and punitive sentencing decisions, whereas individualizing moral foundations would be associated with juror disqualification and a leniency effect. Additionally, we considered whether moral foundations can explain differences in death penalty application between conservatives and liberals. Respondents from two independent samples participated in a mock-juror task in which the circumstances of a hypothetical defendant’s case varied. Results revealed moral foundations were strong predictors of death qualification. The binding and individualizing foundations were related to sentencing decisions in the expected ways. Supporting our contention that moral foundations operate differently across different types of cases, heterogeneity in the effects of moral foundations was observed. Finally, we found support for the hypothesis that the relationship between sentencing decisions and conservatism would be attenuated by moral foundations.
