文化政治视域下的儒家文化复兴及其当代路径

从20世纪90年代至当前,儒家文化复兴已经成为中国文化领域的一个重要文化现象。与之前的儒学复兴不同,当前的儒家文化的复兴立足于对于西方文化与政治联姻的文化政治这一霸权独白的挑战与应战。作为对于中西传统文化的转化与创新,在文化政治视域下当代儒家文化复兴正沿着儒教和政治儒学两个路径发展。

我国诉讼时效之立法模式评价

消灭时效与诉讼时效的直接效果均在于对义务人产生抗辩权,其最终效果均是实体权利本身或其强制力的消灭,且均须通过权利人败诉而得以体现,故二者并无实质区别。鉴于“胜诉权”之消灭并非导致时效效果发生的条件,更不是时效效果本身,只是时效之效果在诉讼程序上的表现,且“诉权二元论”并未为我国诉讼法理论所采纳,故我国诉讼时效之“胜诉权消灭说”应予废止。有关诉讼时效完成后的所谓“自然债务”,实质为道德债务,其无法用来解释义务人在时效完成之后一旦履行债务即不得请求返还的情形。我国在保留诉讼时效制度的同时,应将时效完成的效果规定为债权消灭,但以时效抗辩的主张为生效条件。
