日本法学界注意语言研究

<正> 日本评论社(股份有限公司)出版的《法学研讨会》是已经有30年以上历史的法学杂志(但我国至今还很少介绍该刊的资料)。它很注意语言研究,以一九八五年为侧,就辟有"法律外国语入门"专栏(先后已刊出八期),由京都大学专攻罗马法的柴田光藏教授以德国法学家汉斯·凯任所著《纯粹法学》一书为素材而撰写的。

关于我国企业海外市场风险的识别

对搜查、扣押、冻结等强制性侦查措施检察监督有关问题研究

我国《刑事诉讼法》及有关司法解释对强制性侦查措施的立法规定存在严重不足,缺乏完备的监督制约机制,容易导致权力滥用。在我国现有刑事法律框架内,依据刑事司法权力配置原则,应当建立以检察机关为主导的强制性侦查措施司法审查制度、非法证据排除规则和对违法强制性侦查措施行为的惩罚规定,完善刑事相对人的救济途径,以确保强制性侦查措施的规范、公正、高效使用。     

比例原则下的无效合同判定之展开

无效合同的判定实际上是一个公私利益的权衡过程,在此当中,如何保证无效的判断是适度的则成为这一判定过程中的一个核心问题。而比例原则的运用,则有助于这一目的的实现。在比例原则指导下的合同无效之判定是一个事实判断与价值判断的综合考量过程。其中,合同与社会公共利益的关联性、合同无效的必要性和实效性的判断主要是事实判断的过程,而合同本身的恶劣性、社会公共利益的重要性以及合同无效的均衡性则更多地涉及价值判断。
