Some competent political actors, primarily young people and the cognitively impaired, are excluded from political participation by modern liberal democratic states. This exclusion occurs because the means utilized by states to distinguish between competent citizens (who must be included) and incompetent ones (who may be excluded) are imperfect. They include age restrictions on enfranchisement and, commonly, legal restrictions on enfranchisement for those with cognitive disabilities. Capacity-testing provides a means to improve on these existing mechanisms for exclusion. It is not, however, often suggested, nor seen as viable. Here, I argue that we should utilize capacity-testing to more effectively include capable citizens in our democratic practice. I defend a particular scope and kind of capacity-testing against common objections.  相似文献

Homicide–suicide is a tragic phenomenon which typically does not result in a criminal charge or trial. However, correct diagnosis and classification of homicide–suicide cases are important to determine the perpetrators and dynamics of each category properly. The deaths in the homicide–suicide acts can be divided into two categories with respect to the number of involved individuals: dyadic deaths and triple or multiple deaths. These two categories can also be divided into two subgroups according to the chronology of the incidents: simultaneous deaths and consecutive deaths. Herein, a simultaneous homicide–suicide case of a father and daughter where both deaths occurred through drowning which was not found in the selected literature review and where the victim was a child is presented. The article aims to clarify the term discrepancies about multiple death cases in the literature and to discuss the pathological and psychosocial characteristics of the simultaneous dyadic death cases.  相似文献

Considerable research has documented the effects of community violence exposure on adolescents' behavior and mental health functioning, yet there has been less research on the process by which early risks increase the likelihood that youth will be exposed to community violence. The current study used data from a community epidemiologically defined sample of 623 urban youth followed from 1st grade through adolescence to examine the process by which early-onset aggressive behavior and poor academic readiness influenced risk for community violence exposure. Consistent with transactional developmental theories, early-onset aggressive and disruptive behavior was associated with poor academic readiness; these early risks contributed to later peer rejection, and subsequent conduct problems and greater affiliation with deviant peers, which in turn increased youths' exposure to community violence. Having an enhanced understanding of the risk process directs attention to potential targets for preventive interventions for youth at risk for subsequent exposure to violence.  相似文献

The sulfur dioxide (SO2) cap and trade program established in the 1990 Clean Air Act Amendments is celebrated for reducing abatement costs ($0.7 to $2.1 billion per year) by allowing emissions allowances to be traded. Unfortunately, places with high marginal costs also tend to have high marginal damages. Ton‐for‐ton trading reduces emissions in low damage areas (rural) while increasing emissions in high damage areas (cities). From 2000 to 2007, conservative estimates of the value of mortality risk suggest that trades increased damages from $0.8 to $1.1 billion annually relative to the initial allowance allocation and from $1.5 to $1.9 billion annually relative to a uniform performance standard. With U.S. Environmental Protection Agency (USEPA) values, trades increased damages from $2.4 to $3.2 billion annually compared to the initial allowance allocation and from $4.4 to $5.4 billion compared to a uniform performance standard. It is not clear that the ton‐for‐ton SO2 cap and trade program is actually more efficient than comparable command and control programs. The Miller case concerned the constitutional requirements for the UK to give notice of its intention to withdraw from the EU pursuant to Article 50 of the Treaty on European Union. The parties made submissions in terms of two competing syllogisms. The Government argued that ministers, exercising Crown prerogative, had the power to give notice without statutory authorisation. The Applicants argued that the process required authorisation by Act of Parliament because the UK's withdrawal would deprive people of rights arising under EU law. However, a majority of the Supreme Court decided in favour of the Applicants based on a third and significantly different syllogism, based on the proposition that the European Communities Act had established EU law‐making and law‐interpreting institutions as new ‘sources of law’. This note assesses the three competing syllogisms and examines the constitutional significance of the majority's proposition that these new EU sources of law were integrated into UK domestic law without disrupting the principle of parliamentary sovereignty.  相似文献

The relationship between an abusive environment within the family and proneness to shame, guilt, anger, and hostility in college students revealed that greater exposure to emotional abusiveness was significantly related to higher shame, overt and covert hostility, and expressed and unexpressed anger. Greater exposure to physical abusiveness was significantly related to overt hostility and a tendency to experience anger without a specific provoking situation. Women reported higher shame and guilt, whereas men reported higher levels of overt hostility and expressed anger. Shame proneness was related to covert hostility and unexpressed anger for both men and women. However, guilt proneness was not related to exposure to family abusiveness or, with one exception, to the anger and hostility variables. Implications for therapy with adult survivors of child abuse are discussed.  相似文献
