In jurisprudential literature, the adjective ‘defeasible’ appears as a predicate of many terms: concepts, laws, rules, reasoning,
justification, proof, and so on. In this paper, we analyze the effects of some versions of the thesis of the defeasibility
of legal norms on the reconstruction of the notion of legal validity. We analyze some possible justifications of this thesis
considered as a claim concerning validity, and enquire into two possible sets of problems related to the defeasibility of
the criteria of identification of a legal system. We also provide a formalization of some options regarding defeasible criteria
of identification, which can be used as a tool for meta-jurisprudential analysis. Finally, the thesis according to which defeasibility

This article analyzes the adaptation of the Revolutionary Armed Forces of Colombia (FARC) to the post-Cold War strategic scene. In this process of change the Colombian guerrilla organization has broken away from the traditional behavior patterns of Latin American armed groups in four key ways. First, the FARC has reduced the rigidity of its ideology in order to make its political message more attractive. Second, it has made a great effort to boost its military potential. Third, it has established independent channels of funding and arms supply. Finally, the Colombian rebels have developed a very decentralized organic structure that nevertheless maintains a sufficient degree of cohesion. These innovations have made the FARC a new model of insurgency that has managed to corner the Bogota government and destabilize a significant part of the Andean region. 相似文献

This paper tackles the problem of comparison between proximity and directional voting in 27 European multi-party systems. This is a previously unaddressed aspect of European spatial issue voting. We focus on the spatial voting theories as predictors of vote intention, evaluating the extent of proximity and directional voting. We describe the influence of identical predictions on the comparison of these theories. Our multilevel analysis of the 2009 European Election Study data shows more empirical support for proximity voting than directional voting in the countries analyzed. It does this by clearly differentiating between those cases where it is possible to compare proximity and directional voting and where this is impossible. The paper proposes the concept of ‘marginal pole’ of the economy to characterise a new level of Latin American economic activity, which has a precarious relationship with the basic means of production controlled by the dominant levels of the economy as a whole. The ‘marginalised labour force’ employed here is a distinct new sector within the working population. Decentralized governments in Ghana have not been able to realize optimum benefits from their property tax potentials. The paper investigates the administration of property taxation in Ghana using the Offinso South Municipality (OSM) as a study area. Questionnaires were relied on to garner data from property owners in the municipality. It observed that low coverage and collection ratios, inadequate collection modes, and negative public perceptions have worked against the administration of property tax in the OSM. The paper suggests a complete overhaul of the property rate regime in the OSM if the buoyancy of property tax revenue is to be realized. It argues that the rating authority should purge the system of perceived corruptions. It suggests a revamp of the property rate collection means in order to slump rent seeking behavior of the mobile property rate collectors. 相似文献
