死因查明、认定制度的构建

由于我国现有的死因调查制度存在实体和程序方面的缺失,所以,近年来非正常死亡案件常常引发公共舆论的热议乃至质疑.从死者家属对死亡结论的认可过程看,存在一个由死者亲属与可能的行为人之间存在的纠纷转化为死者家属与公权力机关之间的“纠纷异化”过程.为解决这一问题,应以法治思维为引导,积极借鉴普通法国家和地区的法律制度及其司法实践,系统规划、科学构建,形成符合我国国情、社情的死因查明、认定制度.构建这一制度的关键就是死因查明、认定程序的司法化,即由人民法院审理非正常死亡案件,死因调查权辅助于死因认定权,可由公安机关或相关行政主管部门行使.构建死因查明和认定制度,应主要规范“非正常死亡案件”的界定、适用死因查明、认定程序案件的基本条件、死因查明和认定程序的当事人及权利等问题.     

政府在公立医院回归公益性改革中的主导作用探析

在市场经济大潮的冲击下,作为我国医疗机构主体的公立医院公益意识逐渐淡化,趋利行为日益突出。新医改方案明确了公立医院要遵循公益性质和社会效益原则。对照西方和我国以往经验,公立医院公益性淡化的突出原因是政府责任的缺失和错位。本文提出,政府在新医改过程中应采用多种措施主导公立医院回归公益性。     

严重受阻的欧洲一体化进程

当前欧盟内部各种矛盾突出,维系欧盟前行的＂深化＂和＂扩大＂两个车轮停摆,欧元区呈分裂之势,原指望解决劳动力匮乏的＂申根协议＂难以实施。随着德国对推进欧洲一体化热情减退,德法两国＂火车头＂作用减弱,加上美国干预力度的加大,欧洲逐渐走下坡路的势头恐怕难以避免。     

Her Majesty's Protected Subjects: The Mishaqa Family in Ottoman Damascus

The protégé system that the Ottoman Empire encountered as the result of diplomatic relations with European powers later became a clear threat to the very existence of the empire. Among these powers, Britain, until the nineteenth century, executed its consular affairs via the Levant Company in the Middle East, but later employed local people, mostly non-Muslim Ottomans, as dragomans, consular agents and vice-consuls to execute its services in the region. The dragomans not only translated treaties and official documents, but also commented on the messages to and from the authorities and this gave them much more important roles. In this regard, members of the Mishaqa family served the British and later American interests under different posts ranging from dragoman, to consular agent and vice-consul. As they gained confidence, they were accorded British consular protection which provided them considerable privileges, and passed their duties to their sons. Unlike similar Levantine families who assumed dragomanship in the imperial centre as a household tradition, members of the Mishaqa family were deeply embedded in the local society and therefore could give insights on social and political changes in the Ottoman province of Damascus. After attaining British protection in 1840, members of the family served in British and American consulates until the beginning of the First World War. However, the protégé status of the family members paved the way for continued debates over their nationality and citizenship. This article attempts to present the basic codes of consular protection and Ottoman responses within the context of the story of Mishaqa family.     

公司无效制度研究

公司虽然是一种契约,但是,公司并非一般意义上的契约,它实际上是一种独立的商人。公司一旦设立,即获得独立的法人格,该种法人格不因为公司在设立过程中存在违反法律强制性或者禁止性规定而被否认,因此,现代公司法不承认公司无效制度。我国《公司法》同样不应当设立公司无效制度。

The public participation and the system of the People’s Congress constitute a basic mode of China’s modern democracy. This article first analyzes the lessons from the development of public participatory democracy since the founding of People’s Republic of China, especially those related to the promotion of public participation and the establishment of rule of law in administration and constitutionalism, then, and study the strategic value and potential risks of public participation to the development of human society, the necessity and channels of law protection on public participation. At last, it discusses the trend of public participatory democracy in the environment of globalization and informationization, and its impact on the reconstruction in respect of administrative rule of law and constitutionalism.     

Trafficking in persons report

The Department of State is required by law to submit a Report each year to the U.S. Congress on foreign governments' efforts to eliminate severe forms of trafficking in persons. This Report is the sixth annual TIP Report. It is intended to raise global awareness, to highlight the growing efforts of the international community to combat human trafficking, and to encourage foreign governments to take effective actions to counter all forms of trafficking in persons.     

新疆部分规模化猪场繁殖障碍类疫病的调查与防制

从新疆 13个地区的 2 5个规模化猪场采集猪流产胎儿、死胎和血清等病料 330 0余份 ,进行血清学和病原学检测 ,查明猪瘟和伪狂犬病、猪生殖和呼吸综合征是造成规模化猪场猪繁殖障碍的主要疫病 ;并通过试验研究 ,提出了防制方案 ,在生产中推广应用取得了较好的效果     

美国基金会发展现状及管理制度的考察与借鉴

社会发展与建设有其客观规律,社会组织发展与建设也有其客观规律。本文以美国基金会为侧重点,介绍了其发展现状和管理制度,以及放松管制和加强监管的案例,并在发挥社会组织主体作用、强化财税政策引导、加强公信力建设和能力建设等方面对我国加强社会组织建设提出若干建议。     

The US–Russian security ‘reset’: implications for Central-Eastern Europe and Germany

Abstract

The article examines the reactions of selected European states to the US-performed ‘reset’ in relations with Russia and explores the ways in which they have been adapting to the new set-up. The article is divided into three parts: after the discussion of the substantive continuity and limited change in US foreign and security policy (USFSP), the multilateral and bilateral dimensions of USFSP procedure are examined through John Ruggie's theoretical observations. The second part of the article deals with implications of the USFSP for Central-Eastern European countries. This part begins with a discussion of Russian attempts to wheedle Europe into embracing its plans for new European security architecture. The next section sheds light on the unexpected process of strategic realignment of the region (USA/NATO/EU/CSDP) and simultaneous transformation of the special relationship with the USA into ‘normal life’. The third part of the article tackles the implications of heightened US–Russian bilateralism for Germany. Authors' findings, many of them based on conducted elite interviews, suggest the contrary process, namely Germany's strengthened multilateral commitment to the EU and specifically to European Security and Defence Policy, limiting the bilateral option to energy trade with Russia. What follows are concluding remarks.
