Mainstreaming the Duty of Clarity and Transparency as part of Good Administrative Practice in the EU

Abstract: Language rights in the EU tend to be viewed in terms of the respect of national identity on the one hand and the clear and harmonised application of the internal market on the other. It is argued that an efficient language policy in the EU is one that reconciles respect for diversity with the need for effective communication. The use of specialist jargon in effect consolidates networks and power, of which there are two separate but related dimensions. The first is the external dimension of language, namely the lingua francaof deliberation, be it English, French, German, and so on. The second dimension refers to the use of élite codes, that is, language for ‘insiders’, which operates in spheres of politics, the law, economics, culture, medicine, and so on. It is the latter which the EU language rights régime has neglected. The absence of enabling provisions governing a duty of clear language renders democratic legitimacy intended by the former relatively meaningless. It is argued that the law can protect, facilitate, safeguard, and encourage clarity and transparency as part of good administrative practice. The duty to use language in a clear and comprehensible manner that has arisen in relation to producers in the EC law context of consumer rights is a useful case in point.     

Increasing access to rural maternal health services in Zambia through demand-side interventions

This paper examines a demand-side intervention that significantly increased access to maternal health services in rural Zambia in a context where skilled birth attendance rates had been stagnant for over two decades. Aspects of the intervention design that were crucial to the programme's success were the participatory and adult learning-centred approach used to mobilise intervention communities, the use of a community volunteer model, and the design's sensitivity and responsiveness to underlying social factors and problems. The demand-side intervention is already being scaled up in six districts, and is highly suitable for national level scale-up.     

Vice and virtue of the Basic Structure Doctrine: a comparative analytic reconsideration of the Indian sub-continent’s constitutional practices

This paper examines the doctrine of Basic Structure and its effect upon the development of constitutional jurisprudence on the Indian sub-continent, i.e. Bangladesh, India and Pakistan. It also analyses the courts’ robust underpinning on the doctrine that puts ‘an embargo or a limit upon the parliamentary supremacy’. Such an embargo or a limit is at times seen as a fundamental one which eventually led practical application. Since this position provokes huge controversy, e.g. illegitimacy, anti-democracy, judiciocracy, counter-majoritarianism, anathema to popular sovereignty, non-textual and abstract formulation, etc., it fairly requires doctrinal expositions to be made on how to figure it out. Moreover, it explores the scope, standing and inviolability of the doctrine in the sense of comparative conceptualization. Furthermore, dissection from multifarious perspective is made in order to look into its pragmatism, justification and legitimacy through fixing its today’s position in the ongoing debate among the contemporary constitutional commentators.

Evaluation of Skin Surface as an Alternative Source of Reference DNA Samples: A Pilot Study

An acceptable area for collecting DNA reference sample is a part of the forensic DNA analysis development. The aim of this study was to evaluate skin surface cells (SSC) as an alternate source of reference DNA sample. From each volunteer (n = 10), six samples from skin surface areas (forearm and fingertips) and two traditional samples (blood and buccal cells) were collected. Genomic DNA was extracted and quantified then genotyped using standard techniques. The highest DNA concentration of SSC samples was collected using the tape/forearm method of collection (2.1 ng/μL). Cotton swabs moistened with ethanol yielded higher quantities of DNA than swabs moistened with salicylic acid, and it gave the highest percentage of full STR profiles (97%). This study supports the use of SSC as a noninvasive sampling technique and as a extremely useful source of DNA reference samples among certain cultures where the use of buccal swabs can be considered socially unacceptable.
