The routine production of a cast of a shoe-print taken in soil provides information other than shoe size and gait. Material adhering to the surface of the cast represents the preservation of the moment of footprint impression. The analysis of the interface between the cast and soil is therefore a potentially lucrative source of information for forensic reconstruction. These principles are demonstrated with reference to a murder case which took place in the English Midlands. The cast of a footprint provided evidence of a two-way transfer of material between the sole of a boot and the soil of a recently ploughed field. Lumps of soil, which had dried on a boot, were deposited on the field as the footprints were made. Pollen analysis of these lumps of soil indicated that the perpetrator of the imprint had been standing recently in a nearby stream. Fibre analysis together with physical and chemical characteristics of the soil suggested a provenance for contamination of this mud prior to deposition of the footprint. Carbon/nitrogen ratios of the water taken from the cast showed that distilled water had been used thus excluding the possibility of contamination of the boot-soil interface. It was possible to reconstruct three phases of previous activity of the wearer of the boot prior to leaving the footprint in the field after the murder had taken place. This analysis shows the power of integrating different independent techniques in the analysis of hitherto unrecognised forensic materials.  相似文献

This paper reflects on the experience of presenting a limit test case based on passion/provocation cases against a proposed ??right to passions?? suggested by proponents of a sentimental jurisprudence. Objectives

The development and application of methods to assess consistency in sentencing before and after the 2011 England and Wales assault guideline came into force.

Methods

We use the Crown Court Sentencing Survey to compare the goodness of fit of two regression analyses of sentence length on a set of legal factors before and after the assault guideline came into force. We then monitor the dispersion of residuals from these regressions models across time. Finally, we compare the variance in sentence length of equivalent types of offences using exact matching.

Results

We find that legal factors can explain a greater portion of variability in sentencing after the guideline was implemented. Furthermore, we detect that the unexplained variability in sentencing decreases steadily during 2011, while results from exact matching point to a statistically significant average reduction in the variance of sentence length amongst same types of offences.

Conclusions

We demonstrate the relevance of two new methods that can be used to produce more robust assessments regarding the evolution of consistency in sentencing, even in situations when only observational non-hierarchical data is available. The application of these methods showed an improvement in consistency during 2011 in England and Wales, although this positive effect cannot be conclusively ascribed to the implementation of the new assault guideline.  相似文献

The suppression of Poznan June 1956 workers’ rebellion (Poznanski Czerwiec) by Polish authorities prompted immediate Australia‐wide demonstrations and protests by Polish émigrés who were supported by friends and allies in the Catholic Church and the Australian anti‐communist movement. Nation‐wide demonstrations in Australia and subsequent approaches by émigré Poles and supporters required a disinterested Australian government to develop a position on Poznan June events. Pressure on the Australian government for a response, potentially disruptive to its foreign policies, was applied only by elements within the Australian political scene that posed little threat to its future. Poznan June ‘56's effect on Australia takes place within the particular nature of Australian domestic politics where the June events were used to fan the flames of bitter rivalry within the labour movement by a strident anti‐communist faction seeking to restructure the Australian Labor Party in a manner consistent with its ideological predilections. In taking up the anti‐communist cause of the Polish émigrés, the Australian anti‐communist leadership claimed a moral high‐ground, but lacked sufficient commitment to use their considerable parliamentary advantage to pressure the Australian government to adopt a more muscular position towards Poland's government.  相似文献
