Where Judicial Politics Are Legislative Politics: The French Constitutional Council

Judges on France's ordinary and administrative courts make law and policy by interpreting and applying statutes, but the Constitutional Council is overtly involved in policy‐making. The Council serves as a type of ‘third’ chamber of the French parliament, where it may annul unconstitutional legislation, ‘constitu‐tionalise’ various legal principles, and sometimes even prescribe the precise terms of legislation. This ‘court‐like’ body, thus, plays a significant and growing role in French policy‐making.     

Death penalty sentiment in the United States

Pro-death penalty sentiment, at its all-time low in 1966 at 42% of the country's adult population, steadily rose to 71% in 1986. This average percentage varies widely for various subgroups of the population-as widely as between 43 and 93% at the extremes: political leanings, ethnic background, sex, and economic status are the main determinants. Death penalty sentiments are not of uniform strength: about one-third of the pro-death penalty population might give up their position if the alternative were life without parole and if they were convinced that the death penalty is not a deterrent. In the main, death penalty sentiment is not determined by utilitarian considerations but by moralistic ones, which in turn are part of the liberal-conservative dividing lines.     

Measuring Beliefs About Adolescent Personality and Behavior

A measure that assesses individuals' expectations and stereotypes concerning adolescents was developed. Initially, 123 adult respondents answered open-ended questions about the personality and behavior of typical and observed adolescents. Based on their responses, a close-ended scale was developed where respondents rate the degree to which 65 traits and behaviors are characteristic of typical adolescents. Refinement and testing of this scale was done with a sample of 361 college students and 112 parents of young adolescents; the final number of items after such refinement was 44. The subscales demonstrated adequate internal consistency, test–retest reliability, and construct validity. The multifaceted nature of the measure and absence of stereotypical language, along with its flexibility for obtaining comparable information on other age groups provide advantages over the small number of previously used measures.     

The balanced budget amendment: Clarifying the arguments

From the perspective of a supporter, this paper responds to the several criticisms that have been raised to the proposed constitutional amendment to require budget balance. Economists have concentrated on the loss of fiscal flexibility. This objection is countered by reference to the political inefficacy of attempted budgetary manipulation. Lawyers have concentrated on problems of enforcement. This objection is countered by reference to observed respect to other constitutional rules.
