Potholes on the Path to Purity: Gideon Yaffe’s Overly Ambitious Attempt to Account for Criminal Attempts

Gideon Yaffe??s ??subjectivism about attempts?? rest on the Transfer Principle: ??If a particular form of conduct is legitimately criminalized, then the attempt to engage in that form of conduct is also legitimately criminalized.?? From the perspective of a moral concern with culpability, this principle seems to get to the heart of the matter: the true essence of what is wrong with attempting to commit a crime. Unfortunately, Yaffe??s argument for the Transfer Principle is based on an equivocation and therefore logically unsound. The moral core of the Principle is still sound, but we can??t tell from Yaffe??s book how far that principle would take us in the criminal law.

Economic interest or security concerns? Which affected how individuals in five Asian countries—Indonesia,Japan, Malaysia,the Philippines,and South Korea—viewed China in 2013?

With rapid economic growth, China has become its neighbours’ largest trade partner in the twenty-first century. At the same time, the growth of China’s military and its assertiveness are raising concerns among its neighbours that China’s rise will pose a threat to them. In this context, will China’s neighbours—Indonesia, Japan, Malaysia, the Philippines, and South Korea—view China positively or negatively? By using statistical analysis, this paper aims to explore whether individuals are more affected by their economic position or national security concerns when they view China. The findings in this article suggest that individuals’ security concerns have stronger associations with their attitudes toward China than economic conditions. Specifically, individuals’ views on China’s military growth and territorial disputes had negative effects on their attitudes toward China. On the other hand, economic interests had weaker associations with individuals’ views of China than security concerns.     

Homogeneity of jurors

A dissenting juror faces considerable social pressure from the majority to acept their position. This article postulated that whether the dissenter conforms or not should be dependent, in part, on attributions made about the cause of the majority's behavior. Specifically, it was hypothesized that to the extent the majority jurors are perceived to be independent of one another, their credibility should be high and the dissenter will likely adopt their position. On the other hand, agreement among homogeneous jurors may be attributed to mutual influence or similar personalities and, therefore, discounted as a reliable source of information about the case. Two studies investigated the relationship between both attributions of independence and social influence, and the homogeneity of the jurors attempting influence. Overall, findingsfrom the studies indicate that the manner in which jurors are initially categorized into social groups affects their perceived independence and persuasive impact.This research was supported, in part, by the NIH under grant No. 29807 and by the Rutgers University Research Council.
