泰国温和应对中国崛起的动因与启示(1997～2012)

1997年亚洲金融危机之后,与美国的其他东亚盟国相比,泰国对华政治安全政策明显较为温和。本文认为,推动泰国温和应对中国崛起的根本因素在于危机之后泰国不断强化其经济优先的国内战略。为了落实这一发展战略,与中国没有直接安全矛盾的泰国,乐于采取温和的政治安全政策以强化与中国的友好关系,深化与中国的经济合作,为其落实经济优先战略创造更为有利的外部条件。在这一过程中,中国在泰国处于危难之际及时提供援助对于泰国温和政策的形成也发挥了一定的作用。泰国的经验表明,与中国没有战略矛盾并不足以保证周边国家采取温和政策,以积极应对中国实力的不断崛起。更加值得注意的是,泰国因注重与中国的经济合作而在政治安全上温和应对中国崛起的实践非常特殊,并不具有普遍性。中国有必要尽早实现东亚地区经济政策和安全政策的协调一致,并针对东亚国家安全政策和安全威胁的不同特点,设计差异化的安全政策,以有效缓解在周边外交中遭遇的崛起困境。     

Guessing in the Gaps

The genesis of this conversation was the forthcoming new Penguin edition - under the general editorship of Adam Phillips - of the works of Freud. Mark and Phillips consider the concept of a 'literary' Freud alongside the 'scientific'or 'clinical' Freud, and discuss the related issues of translation, representation and interpretation, particularly as they bear on psychoanalytic writing. Adam Phillips's relationship to the institutions of psychoanalysis is considered, and the perpetuation of these institutions through the training of psychoanalysts and psychotherapists. Also discussed is the project of psychoanalysis: the nature of psychoanalysis as a therapy as well as a body of ideas. Mark and Phillips make reference to the work of Freud, Lacan, Klein, Winnicott and Laplanche, and to concepts such as the 'enigmatic signifier' and 'transgenerational haunting'.     

矫正社会化的国外实践及其启示

以人为本是当今社会活动的主题和价值追求,矫正社会化充分体现了以人为本的矫正理念和社会发展趋势。美国、日本和澳大利亚等国是矫正社会化发展较为先进的国家,其社会服务制度、社区矫正制度、更生紧急保护制度等值得我们学习和借鉴。我国需制定《社区矫正法》及相关制度,加强全社会对矫正社会化的参与程度,充分保障犯罪者合法权益,以使其早日回归社会。     

论ADR在社区物业管理纠纷化解机制中的适用

运用富含自足性与自治性等法理意义的ADR解决物业管理纠纷对于当事人来说,或许在实体权益上需做出退却,但能节省更多成本,获得更多尊重和相比诉讼而言更好的效果。实证表明,ADR乃化解物业管理纠纷的良径。而ADR的制度建设,更是其长远有效发展的必要保障。     

Minorities and the public service: a future perspective

This paper analyzes the future prospects of blacks and other minorities in the public service. It examines studies on race/role expectations of minority administrators, tokenism and marginality to discern trends in interethnic relations. It also discusses future demographic projections and their implications for majority/minority relations. Finally, the essay explains why public service careers are particularly significant for blacks and other minorities.     

不同年龄段博士职业发展质量性别差异实证研究——基于劳动力市场转型背景下体制内就业的分析视角

本文利用中国博士发展质量调查数据库,探索了劳动力市场转型期体制内就业博士职业发展质量的性别差异水平。数据分析结果表明:在全体受访的体制内就业博士中,31-40岁博士职业发展质量的性别差异最明显。我们认为导致这种现象出现的原因在于:31-40岁女博士工作关联度相对较低,以及这一年龄段女博士的理性选择和体制内组织的统计歧视。我们还发现,由于计划生育政策效应,以及现代化、全球化所导致的文化变迁的影响,30岁以下博士职业发展质量的性别差异较31-40岁博士有所降低。     

中国乡村治理模式的创新:从“乡政村治”到“乡村民主自治”

改革开放以来,中国乡村逐渐形成了以乡政村治为主要标志的中国乡村治理模式。然而,随着市场经济的发展和村民自治的深入,乡政村治模式设计的局限性逐渐表现出来。乡村民主自治的领域应当适时扩大到乡一级,把乡政村治模式提升为乡村民主自治模式。为此,要构建乡村民主自治模式的制度框架,并为制度的良性运行提供经济、文化和社会基础。     

论中国援外不附加政治条件原则的理论基础及现实意义

不附加政治条件原则的雏形是中国援外八项原则中的不附加任何条件原则。伴随中国改革开放和援外体制改革,期间曾表述为不附加任何政治条件。只字之差,反映了中国援外政策的变与不变之道。国家主权平等原则、不干涉原则以及经济发展的内在性要求,是不附加政治条件原则的理论基础。西方国家之所以歪曲和批评这一原则,归根结底还是出于对中国影响力上升的猜忌和遏制。着眼长远,中国援外的国际化道路是一个必然趋势,但是在变与不变之间,不附加政治条件原则仍将具有长久的生命力。     

Sex as Slavery? Understanding Private Wrongs

The era of globalization has been accompanied by an increased awareness of private wrongs as well as acceleration of many forms of cross-border labor exploitation. The essay explores how refined distinctions between forced and free sex work could improve anti-trafficking policies. It addresses the understudied linkages between other forms of migration and sexual exploitation and suggests a triage approach to all forms of labor exploitation—based on harms rather than type of labor or victim. A better understanding of freedom, sex, and development will allow us to expand a human rights approach to these private wrongs. The best anti-trafficking policy is one of universal, indivisible human rights. Victims of sexual exploitation need the same things as all migrants and all workers—recognition, monitoring, resources, access to justice, and organization.     

候保期间事故之赔付探讨

候保期间发生保险事故是否应当赔付的问题,是困扰我国司法界的一个难题。如果投保人在投保前已经交付保险费,基于对价平衡、合理期待等理论,保险人应当承担候保期间事故的赔付责任。学术界对此种赔付的性质有三种不同认识:缔约过失责任、侵权责任以及未成立之保险合同的契约责任,但这三种认识都存在问题,保险人承担的责任应当为临时保险的契约责任。我国未来建立临时保险制度的方向应当确定为:在投保人已经交付保险费的情况下,保险人必须提供不附条件的临时保险;在投保人未交付保险费的情况下,保险人可以自愿为被保险人提供临时保险。
