In this paper I examine the presence of rape myths and gender stereotypes, and the norms of sexuality they reflect and reinforce, in Croatian rape laws, as exemplified by the recent practice of the Zagreb County Court. I begin with a general discussion of the gendered myths and stereotypes that have shaped the content and application of the criminal law of rape everywhere. I then briefly introduce the definition of rape under the 1997 Croatian Criminal Code which was in force at the time of my research, after which I proceed to the critical analysis and the assessment of the Zagreb County Court practice. Next, I turn to the changes in the new Criminal Code to see how they address the identified problems. I offer a model of an affirmative consent standard, based on a communicative model of sexuality, which values reciprocal responsibility, communication and mutuality of sexual desire. I argue that this standard has greater potential to challenge rape myths and gender stereotypes and to promote sexual freedom and gender equality.  相似文献

The main goal of this research is to identify the reasons for gender differences in European volunteer rates in different types of voluntary organisations. To that end, we focus in volunteer rates at individual and national levels. We have drawn our data from the European Values Survey (EVS, 1999 and 2008). We have employed Logit models carrying out independent estimations for the individual likelihood of working as a volunteer for four categories: social awareness, professional, education and social justice. We have carried out independent estimations and we have also repeated estimations by gender subsamples. Our main result is that social factors might be even more relevant for decisions to volunteer than individual socio-economic factors. Specifying the peer group as much as possible allows better control of social variables. For example, studying the female volunteer rate is more relevant to control for the female national NGO membership rate than the total national rate. We also highlight important gender differences. For example, education is positively correlated with decisions to volunteer for both genders in all categories, but the educational effect is stronger for men in relation to professional activities and stronger for women in relation to social awareness and social justice activities.  相似文献

For nearly five decades, the European Court of Justice (ECJ) has developed a decisively pro-European case law and has become the ??engine of integration??. Institutional explanations shed light on the Court??s room for manoevre. They have to be complemented by actor-centered explanations that shed light on the judges?? motives of action. The explanation offered by the following paper is unfolded in two steps. In the first one, the article describes idiosyncrasies of the European law discourse that already shaped the judges before they were appointed. The analysis of the idiosyncrasies corresponds to a scepticism towards the idea of national sovereignty, a belief in the necessity of creative and idealist, law-augmenting judges and a dominance of output-oriented legitimization strategies. In a second step, the article shows that in the sociological sense the ECJ judges constitute a group. While the individual judges share an understanding of the aims and functions of European law, the group develops its own identity and grants status to those who perform successful actions with respect to the common integration agenda. This explanation is more realistic than ??rational choice?? explanations which point to the direct and personal benefits that judges derive from their pro-European case law.  相似文献

Appraisals about the implications of stressful events that are evaluated as involving a threat to self (negative self-evaluation, negative evaluation from others, rejection by others) have been shown to place youth at risk for the development of mental health problems. This longitudinal study tested a protective-stabilizing interactive model, in which high maternal acceptance was predicted to mitigate the prospective relation between threat to self appraisals and change in adolescents’ mental health problems six months later. Participants were 89 adolescents from divorced families ages 10–12 and residential mothers. Adolescents reported on threat to self appraisals from the most stressful event experienced in the past month. Mothers and youth reported on maternal acceptance and mental health problems. Multiple regression analyses provided support for the protective effects of maternal acceptance on adolescents’ mental health problems. Intervention implications are discussed. The U.S. Supreme Court held in Wilson v. Arkansas (1994) that the common law “knock-and-announce” principle formed part of the “reasonableness” inquiry under the Fourth Amendment. However, the Court’s opinion gave little guidance as to what would be unreasonable under these circumstances. Some critics expressed concern that this lack of guidance would lead to many variations among lower courts. Other observers discerned a signal that little should be deemed “unreasonable” in the context of “knock and announce.” These criticisms are analyzed through a review of lower court interpretations of Wilson.  相似文献

Employees rate the fairness of organizational policies by applying principles of distributive and procedural justice. Using Leventhal’s (1980) Principles of Procedural Justice, the current study surveyed 279 upper-level college and graduate students to determine the impact each principle has on support for drugtesting policies. The results support the hypothesis that drug-testing programs that violate these principles are viewed as unfair.  相似文献
