Juvenile institutions were developed in the nineteenth century. In the United States, they prompted an extension of the parens patriae doctrine, which provided a basis for the creation of the juvenile court a century ago. The protective orientation of the court was intended both for juvenile delinquents and children in danger. Important changes have occurred since the 1960s. Procedural guarantees for delinquents and de-institutionalisation of children in danger have created a clear distinction between the two groups. Diversion has introduced an alternative to the court process. Policies aimed at young offenders have moved gradually in the direction of the adult criminal court model. Religiosity in Hungary is not especially high; however, the vast majority of the population has a denominational identity. There has been a religious revival since the early 1980's, both in the mainstream churches and due to some religious groups newly active in the country. Religious claims are mostly accommodated on an individual basis. Legal entities called churches can be founded for the purpose of exercising religion, but the registration of a church is not a condition of the free exercise of religion. Religious freedom is guaranteed by the Constitution. The Hungarian state regards itself neutral in matters concerning ideology and religion. Church and state operate separately. The state, however, appreciating religious phenomena, provides support for churches and is open for cooperation with them on a sophisticated legal basis. A new method of offering state support for religions using taxpayer choices is described, which shows some interesting patterns of support for minority faiths as well as traditional ones.相似文献
The article presents an analysis of the disjunction between civil and political society in Perú and its consequences in the collapse of the political parties and the rise of an authoritarian regime. It explains how citizenship developed as social rights in the realm of Peruvian civil society before the population gained access to full civil and political rights. This situation diminished the capacity of Peruvian citizens to have their own political representation and created a distance between Peru's civil and political societies, making it difficult for the population to hold politicians accountable for their actions in government and the opposition. This situation proved particularly serious when the country went through a period of deep economic crisis and extended political violence during the 1980s. The breach between civil and political society destroyed the prestige of politicians and democracy, paving the way for an authoritarian cuadillo who dismissed representation with promises of "direct communication with the people" and harsh solutions to the problems of economic crisis and political violence. 相似文献
Except for the mobility constraints imposed on political decisions of lower-level governments, public choice analysts assume that the working of the political process under federalism remains the same at all levels of governments as under unitary state. This paper argues that one dimension of the political process in a federalist framework lends itself to specific economic analysis, namely the fact that, once constitutional limits break down and functions overlap, two or more levels of government compete for the same voters in the supply of services in a given territory. Viewing votes as inputs in the production of political outputs, the conventional analysis of allocation under common-property rule should shed light on the outcome of this process. The analysis shows that it is in the interest of both suppliers to seek to gain the votes in being first to implement programs. There are thus two forces operating in a typical federalist system, an expansionist one rooted in the political dynamics analysed here, and a restrictionist one based on the mobility of resources among decentralized entities. This may explain why the empirical record is rather mixed on the contribution of federalism to containing government growth. The consequences of this process are derived and possible avenues for improvement are explored. 相似文献
This article, written from an Aboriginal perspective, explores the problematic invitation to federal citizenship in Canada for Aboriginal peoples. Its focus is on the deficits of such an offering for the constitutional rights of Aboriginal peoples, which is characterized by sui generis and treaty citizenship. Informed by Aboriginal and intercultural perspectives, the article argues that the offerings of statutory citizenship for Aboriginal peoples inverts rather than respects the constitutional relationship. It looks at how the Supreme Court of Canada has located and structured sui generis Aboriginal orders, the concepts of sui generis citizenship, treaty federalism, and constitutional supremacy as compared with the idea of federal citizenship, concluding that such 'invitations' to Canadian citizenship are inconsistent with and infringe upon the constitutional rights of Aboriginal peoples. By understanding the prismatic nature of Canadian federalism in a postcolonial context, this article aims at reconceptualizing Canadian citizenship in terms of ecological belonging, fundamental rights, and respect for human diversity and creativity. 相似文献
