This article discusses a unique organization in the regulatory world, the Brazilian Association of Regulatory Agencies (ABAR), which brings together federal, state, and municipal regulatory agencies across different policy sectors. The paper argues that as a regulatory policy network, ABAR has been crucial to the professional socialization, capacity building, and institutionalization of regulators in Brazil. Moreover, it has promoted their identity as professionals and differentiated them from politicians, regulatees, and societal actors. Thus, while ABAR raises the shield of expertise to secure independence from political and social interference, it has itself become a relevant actor in the country's regulatory political dynamics, contributing as such to the strengthening of the Brazilian regulatory state.  相似文献

Scholars interested in legislative processes pay relatively little attention to the changes made to bills in parliamentary democracies. On the one hand, comparative research has often described parliamentary institutions as ineffectual vis‐à‐vis cabinets throughout the lawmaking process; on the other hand, for a long time the rational choice literature has focused more on the formal rules regulating amendatory activity than on amendatory activity itself. Hence, very few studies have tried to explain how much government bills are altered in parliament and why. This article investigates the changes made to governmental legislation in Italy. Taking the modifications occurring during the legislative process as the dependent variable, a number of explanatory hypotheses derived from both existing scholarship and original arguments are discussed and tested. This also allows the identification of some usually unobserved aspects of the decision‐making process within the cabinet. The findings can also be relevant for comparative research since Italy has been characterised during the period under scrutiny (1987–2006) by two distinct electoral systems, two extremely different party systems (pivotal and alternational), governments with various ideological orientations and range, and both partisan and technical ministers.  相似文献

This paper seeks to unravel some of the tangled threads of contemporary rights talk. For some, the grounding of rights‐based approaches in human rights legislation makes them distinctively different to others, lending the promise of re‐politicising areas of development work—particularly, perhaps, efforts to enhance participation in development, that have become domesticated as they have been ‘mainstreamed’ by powerful institutions like the World Bank. Others complain that like other fashions, the label ‘rights‐based approach’ has become the latest designer item to be seen to be wearing, and has been used to dress up the same old development. We pose a series of questions about why rights have come to be of interest to international development actors, and explore the implications of different versions and emphases, looking at what their strengths and shortcomings may come to mean for the politics and practice of development.  相似文献

Increasing expectations of citizen involvement as well as demographic changes brought by population ageing make evidence about the factors impacting on seniors’ participation increasingly important for local governments. In particular, knowledge about motivations for involvement can assist local governments in attempting to attract input from more than just the usual suspects, and to determine whose interests are represented. This article reports on an Australian study exploring seniors’ motivations for participation in governance processes, using a two-phase mixed method approach. Findings from this study suggested that seniors’ participation was motivated by both self- and other-directed, and both practical and abstract factors. Comparison of the sources highlighted nuances in the data which reflect questions about representation, representativeness and inclusion. Findings are discussed in relation to these questions, and implications for local government engagement practices are addressed.  相似文献

Purpose. There were three objectives of this study: (1) To assess the possibility of using pupil diameter as an index of deception in the context of a comparison question polygraph test. (2) To determine if pupil diameter would make a significant contribution to an optimal multivariate classification equation in combination with the traditional predictor variables used in field polygraph practice. (3) We explored the possibility of replacing one or more of the traditional predictor variables with pupil diameter. Methods. We used a laboratory mock crime experiment with 24 participants, half of whom stole $20 (US) from a secretary's purse. Participants were tested with a comparison question test modelled after standard field practice. Physiological measures were taken with laboratory quality instrumentation. Features were extracted from the physiological measures. Those features were subjected to a number of different statistical analyses. Results. Innocent participants showed larger increases in pupil diameter in response to probable‐lie questions than to relevant questions. Guilty participants did not show differential responding to the question types. The additional of pupil diameter to a multivariate classification model approached, but did not reach significance. Subsequent analyses suggest that pupil diameter might be used to replace the traditional relative blood pressure measure. Conclusions. Pupil diameter was found to be a significant predictor variable for deception. Pupil diameter may be a possible replacement for the traditional relative blood pressure measure. Additional research to explore that possibility would seem to be warranted.  相似文献

This article examines the use of the term ‘sustainabledevelopment’ in Acts of the Scottish and UK Parliaments.It begins by examining the UK's traditional reluctance to legislateon sustainable development, the more recent reversal of thatapproach and some definitional issues surrounding the term.It then moves on to consider the sustainable development provisionsin detail examining their form, strength and limits, and howthey can be monitored, reviewed and enforced both inside andoutside court. The article concludes that over and above anysymbolic value, in many instances the provisions also have legalsignificance. The formulations vary and while some are simplymaterial considerations to be used in decision-making, thosewhich set out mandatory requirements such as reports do createbinding legal rules. Furthermore, there are a few examples wherethe duty or objective is set out as a clear legal rule thatcould be interpreted as providing a framework for decision-making.  相似文献

Sudden fatal cases of influenza B infection in a 4-year-old girl and a 2-year-old boy are presented. Both children complained of abdominal pain without respiratory, neurologic or cardiac symptoms; additionally the girl had vomiting within 2 days of death. Autopsy revealed histological changes in the respiratory system consistent with a viral infection. Influenza B infection was identified by immunohistochemistry in the girl and real-time polymerase chain reaction in the boy. Additional testing including cultures, toxicology, and screening for metabolic disorders were negative. These cases illustrate the usefulness of viral testing, especially for influenza, in the medical legal autopsy of children even when the classic respiratory symptoms of flu are lacking.  相似文献

The 608-bp hypervariable region 1 (HV1) sequences from 36 local dogs were analyzed to characterize the population genetic structure of canid mitochondrial DNA (mtDNA). Sixteen haplotypes were identified. A 417-bp segment of this sequence was compared with GenBank sequences from a geographically representative sample of 201 dogs, two coyotes, and two wolves. Sixty-six haplotypes were identified including 62 found only in domestic dogs. Fourteen of these correspond to the 16 local haplotypes and were among the most frequent haplotypes. The local sample was judged to be representative of the much broader geographic sample. No correlation was observed between local haplotypes and the owner's characterization of dog breed. A 60-bp variation "hotspot" within the canid HV1 was identified as a potentially valuable molecular tool, particularly for assaying limited or degraded DNA samples.  相似文献

To date, there has been very little research into the phenomenon of female-perpetrated institutional child sexual abuse (CSA). This study explored 71 cases of CSA perpetrated by women working with children, considered by UK police and courts between 2000 and 2016. Qualitative and quantitative content analysis was employed to examine court reports, professional regulatory body decisions, media reports and an online sentencing database in order to identify perpetrator and victim characteristics, the nature of the offending behaviour, modus operandi and criminal justice system responses. Findings indicate most women offended alone and had no previous criminal or employment records of concern. Victims were typically male and 15–16 years old. Most women received custodial sentences, typically of 2–3 years in length. Implications for policy and practice are also discussed.  相似文献

Many scholars and policymakers are concerned that the emergence of drone warfare—a first step toward the robotics age—will promote instability and conflict at the international level. This view depends on the widely shared assumption among International Relations scholars that military hardware spreads easily, especially in the age of globalization and real-time communications. In this article, we question this consensus. Drawing from the literature in management, we advance a new theory of diffusion of military innovations and test its two underlying causal mechanisms. First, we argue that designing, developing, and manufacturing advanced weapon systems require laboratories, and testing and production facilities, as well as know-how and experience that cannot be easily borrowed from other fields. Second, we argue that the adoption of military innovations requires both organizational and infrastructural support. We test our two claims on three types of combat-effective drones: loitering attack munitions (LAMs), intelligence surveillance and reconnaissance drones (ISR), and unmanned combat autonomous vehicles (UCAVs). We find that even wealthy, advanced, and militarily capable countries such as the United States, the United Kingdom, Germany, and France have struggled to produce or adopt such platforms. We conclude that concerns about the diffusion of drone warfare appear significantly exaggerated, as do claims that globalization redistributes military power at the global level. More generally, our analysis sheds light on how the interaction between platform and adoption challenges affects the rate and speed of diffusion of different military innovations.  相似文献
